A bill for an act
relating to human services; extending implementation
of statewide elderly waiver services covered under the
prepaid medical assistance program; specifying the
evaluation of collaborative service models; amending
Minnesota Statutes 2004, section 256B.69, subdivision
6b.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 256B.69,
subdivision 6b, is amended to read:


Subd. 6b.

Home and community-based waiver services.

(a)
For individuals enrolled in the Minnesota senior health options
project authorized under subdivision 23, elderly waiver services
shall be covered according to the terms and conditions of the
federal agreement governing that demonstration project.

(b) For individuals under age 65 enrolled in demonstrations
authorized under subdivision 23, home and community-based waiver
services shall be covered according to the terms and conditions
of the federal agreement governing that demonstration project.

(c) The commissioner of human services shall issue requests
for proposals for collaborative service models between counties
and managed care organizations to integrate the home and
community-based elderly waiver services and additional nursing
home services into the prepaid medical assistance program. new text begin The

additional nursing home services into the prepaid medical
assistance program may not proceed until completion of the
evaluation under paragraph (d).

(d) Notwithstanding Minnesota Rules, part 9500.1457,
subpart 1, item C, elderly waiver services shall be covered
statewide no sooner than July 1, deleted text begin 2006 deleted text end new text begin 2008new text end , under the prepaid
medical assistance program for all individuals who are eligible
according to section 256B.0915. The commissioner may develop a
schedule to phase in implementation of these waiver services,
including collaborative service models under paragraph (c). The
commissioner shall phase in implementation beginning with those
counties participating under section 256B.692, and those
counties where a viable collaborative service model has been
developed. In consultation with counties and all managed care
organizations that have expressed an interest in participating
in collaborative service models, the commissioner shall evaluate
the models. The commissioner shall consider the evaluation in
selecting the most appropriate models for statewide
implementation.

collected from all elderly waiver services contractors,
including the health plans and the counties who will provide
these services, to ensure a consistent evaluation of services,
satisfactory service outcomes, and continued systemwide
improvements for all recipients of service. The evaluation must
include, but is not limited to, the consumer outcomes in clauses
(1) to (5):

new text begin (1) the rate of preventable hospitalizations remains the
same or decreases from current levels;

new text begin (2) there are no interruptions in service when a consumer
transfers between elderly waiver services, alternative care
waiver services, or other senior support services;

new text begin (3) consumer satisfaction is at the 75th percentile or
greater;

new text begin (4) there are no disparities in consumer outcomes between
ethnic or cultural groups; and

new text begin (5) the retention of county social service staff to ensure
the outcomes in clause (1) to (4).
