A bill for an act
relating to estate sale conductors; requiring a license; amending Minnesota
Statutes 2013 Supplement, section 325E.70, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2013 Supplement, section 325E.70, is amended by
adding a subdivision to read:

new text begin (a) The county auditor shall license a person having the
qualifications specified in paragraph (b) as an estate sale conductor. The license must be
issued by the auditor and authorizes the licensee to conduct the business of an estate sale
conductor in the state of Minnesota for a period of one year. The license must be recorded
by the auditor in a book kept for that purpose. The license must specify the county
issuing the license and must contain a number that individually identifies the estate sale
conductor holding the license. Before the license is issued, the applicant shall pay into
the county treasury a fee of $10.

new text begin (b) A natural person is qualified to be licensed as an estate sale conductor if the person
is 18 years of age or over and is a resident of the state of Minnesota. A copartnership,
association, or corporation may not be licensed as an auctioneer. However, nothing in
this subdivision prevents auctioneers who are duly licensed under this chapter from
combining in associations, copartnerships, or corporations, provided that each member of
the association or copartnership and each person or agent conducting estate sales on behalf
of the business entity is a duly licensed estate sale conductor as provided in this chapter.
