A bill for an act
relating to animal cruelty; requiring protection of animals in the cargo portion
of certain motor vehicles; proposing coding for new law in Minnesota Statutes,
chapter 343.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

A person who transports an animal on a public
roadway in the cargo portion of a motor vehicle must ensure that the animal is protected in
a manner that prevents the animal from falling, jumping, or being thrown from the vehicle.

A person complies with this section if:

(1) the space is enclosed;
new text end
new text begin
(2) the space has racks on all open sides with adequate height and density to retain
the animal;
new text end
new text begin
(3) the animal is cross-tethered to the vehicle; or
new text end
new text begin
(4) the animal is transported in a cage or container secured to the vehicle.

Subdivision 1 does not apply to a dog being transported by:

(1) a farmer, as defined in section 500.24, or a farm employee while the farmer or
employee is engaged in agricultural activities on the farm or within five miles of the farm; or

(2) a licensed hunter in possession of applicable licenses and permits who is engaged
in hunting activities at or within five miles of a hunting site during the legal season for the
hunting activities.
