A bill for an act
relating to public safety; requiring commissioner of
public safety to adopt rules to protect victims of
identity theft from invalid criminal suspicion;
proposing coding for new law in Minnesota Statutes,
chapter 299A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

THEFT.

new text begin (a) The commissioner of public safety shall consult with
state and federal law enforcement agencies on determining,
establishing, implementing, and administering the most efficient
plan or system feasible, in terms of speed and accuracy, by
which a peace officer is able to quickly determine that a
subject of a criminal inquiry or investigation is a victim of
identity theft, not a valid suspect in a crime.

new text begin (b) The commissioner shall:

new text begin (1) consider a supplemental identification card system for
victims of identity theft, including but not limited to criteria
for showing that an applicant's identity was stolen, information
needed on the card, the card's duration, factors that would
warrant refusal to issue a card or to cancel a card already
issued, and other procedures and factors;

new text begin (2) determine the feasibility of coordinating activities
with state and national crime information databases;

new text begin (3) determine feasibility of coordinating information and
activities with national, state, and local law enforcement
agencies;

new text begin (4) recommend changes to law necessary or desirable, if
any; and

new text begin (5) conduct studies, appoint task forces, and make findings
as the commissioner deems necessary or helpful.

new text begin (c) By December 31, 2006, the commissioner shall adopt
rules establishing and implementing the system described in
paragraph (a).
