  1.1                          A bill for an act 
  1.2             relating to public safety; regulating public safety 
  1.3             officer's survival benefits; providing educational 
  1.4             benefits for certain surviving children. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [AUTHORIZATION OF EDUCATIONAL BENEFITS.] 
  1.7      Subdivision 1.  [ELIGIBILITY.] A person is eligible for 
  1.8   educational benefits under Minnesota Statutes, section 299A.45, 
  1.9   if the person: 
  1.10     (1) is the surviving child of a volunteer firefighter 
  1.11  killed in the line of duty on November 18, 1985; 
  1.12     (2) was born on March 24, 1969, July 23, 1970, or May 24, 
  1.13  1973; and 
  1.14     (3) received survivor benefits under Minnesota Statutes, 
  1.15  section 299A.44, but, through no fault of the person, was not 
  1.16  awarded educational benefits before reaching age 23. 
  1.17     Subd. 2.  [AWARD OF BENEFITS.] Notwithstanding the age 
  1.18  qualification in Minnesota Statutes, section 299A.45, the 
  1.19  commissioner of public safety shall, within 30 days of the 
  1.20  effective date, award educational benefits to any person who 
  1.21  meets the eligibility criteria set out in subdivision 1.  
  1.22  Benefits awarded under this section are renewable in accordance 
  1.23  with section 299A.45, subdivision 4. 
  1.24     Sec. 2.  [EFFECTIVE DATE.] 
  1.25     Section 1 is effective the day following final enactment.  
  2.1   Authority to pay or renew benefits under section 1 expires five 
  2.2   years from the effective date.
