  1.1                          A bill for an act 
  1.2             relating to environment; requiring notice regarding 
  1.3             the use of wood treated with arsenic; proposing coding 
  1.4             for new law in Minnesota Statutes, chapter 116.  
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [116.931] [WOOD TREATED WITH ARSENIC; NOTICE.] 
  1.7      (a) The following persons must provide notice regarding the 
  1.8   use of wood treated with arsenic: 
  1.9      (1) a retailer of wood treated with arsenic, inorganic 
  1.10  arsenic, or an arsenic copper combination such as chromated 
  1.11  copper arsenate wood preservative fungicide, or a product 
  1.12  containing wood treated with these materials, must provide each 
  1.13  noncommercial purchaser of treated wood with the notice 
  1.14  specified in paragraph (b); and 
  1.15     (2) a contractor or subcontractor engaged to construct 
  1.16  improvements to a residential structure must provide the owner 
  1.17  of the structure with the notice specified in paragraph (b). 
  1.18     (b) In addition to any other notice required by law, the 
  1.19  notice required under this section must prominently state as 
  1.20  follows:  "Urgent Notice:  This Wood is Treated with Arsenic.  
  1.21  If children come into contact with this wood, you should seal 
  1.22  this wood with a nontoxic sealant once every two years.  Do not 
  1.23  burn this wood in an open fire, and do not use for cooking." 
  1.24     (c) Failure to provide this notice shall result in a full 
  1.25  and timely refund of amounts paid to the retailer, contractor, 
  2.1   or subcontractor.
