A bill for an act
relating to traffic regulation; requiring vehicle towing under certain conditions;
amending Minnesota Statutes 2008, section 169.041, subdivision 3, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 169.041, subdivision 3, is amended to read:


Subd. 3.

Four-hour waiting period.

new text begin (a) new text end In enforcing state and local parking
and traffic laws, a towing authority may not tow, or allow or require the towing of, a
motor vehicle from public property for a parking or traffic violation until four hours after
issuance of the traffic ticket or citation, except as provided in this section or as provided
for an unauthorized vehicle in section 168B.04.

new text begin (b) Unless a vehicle is towed without regard to the waiting period under paragraph
(a), as provided in subdivision 4, a peace officer, or within the department's eight-county
metropolitan district an authorized employee of the department's freeway service patrol,
shall tag a vehicle that is parked within the right-of-way of a controlled-access highway.
The tagging must, at a minimum, indicate the date and time of initial identification of the
vehicle as subject to towing after the waiting period.

Sec. 2.

Minnesota Statutes 2008, section 169.041, is amended by adding a subdivision
to read:

vehicle that:

new text begin (1) is properly tagged and identified as parked for more than 24 hours in the same
location; and
