  1.1                          A bill for an act 
  1.2             relating to public administration; authorizing 
  1.3             spending to acquire and better public land and 
  1.4             buildings and other public improvements of a capital 
  1.5             nature with certain conditions; establishing an 
  1.6             advisory council; requiring a report; authorizing 
  1.7             issuance of bonds; appropriating money. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9                                                    APPROPRIATIONS

  1.11  Section 1.  CAPITAL IMPROVEMENTS
  1.12  APPROPRIATIONS
  1.13  The sums in the column under 
  1.14  "APPROPRIATIONS" are appropriated from 
  1.15  the bond proceeds fund, or other named 
  1.16  fund to the state agencies or officials 
  1.17  indicated, to be spent to acquire and 
  1.18  better public land and buildings and 
  1.19  other public improvements of a capital 
  1.20  nature as specified in this act. 
  1.21  Sec. 2.  PUBLIC SAFETY                               10,000,000
  1.22  To the commissioner of public safety 
  1.23  for grants and loans to political 
  1.24  subdivisions for replacement or 
  1.25  restoration of water or sewer systems 
  1.26  or public schools destroyed or damaged 
  1.27  by flooding in 1997.  This 
  1.28  appropriation is intended to provide 
  1.29  the state match, if required, for 
  1.30  capital projects funded through federal 
  1.31  disaster assistance programs. 
  1.32  Sec. 3.  NATURAL RESOURCES
  1.33  Subdivision 1.  To the commissioner of
  1.34  natural resources for the purposes 
  1.35  specified in this section                            10,000,000
  1.36  Subd. 2.  Flood Hazard Mitigation Grants              6,000,000
  2.1   For the flood hazard mitigation grant 
  2.2   assistance program to local government 
  2.3   units for capital improvements to 
  2.4   prevent or alleviate flood damages to 
  2.5   public lands, facilities, or capital 
  2.6   improvements.  The commissioner shall 
  2.7   determine project priorities as 
  2.8   appropriate based upon need as provided 
  2.9   in Minnesota Statutes, section 103F.161.
  2.10  Subd. 3.  Property For Passive
  2.11  Recreational Use                                      4,000,000
  2.12  For local grants under Minnesota 
  2.13  Statutes, section 103F.161, for 
  2.14  acquisition and betterment of public 
  2.15  land and improvements for passive 
  2.16  recreational use.  Grants made under 
  2.17  this section are intended for the 
  2.18  acquisition of property developed for 
  2.19  residential use which is located in 
  2.20  flood prone areas and for conversion of 
  2.21  that property to passive recreational 
  2.22  use. 
  2.23     Sec. 4.  [BOND SALE AUTHORIZATIONS.] 
  2.24     To provide the money appropriated in this act from the bond 
  2.25  proceeds fund, the commissioner of finance, on request of the 
  2.26  governor, shall sell and issue bonds of the state in an amount 
  2.27  up to $20,000,000 in the manner, upon the terms, and with the 
  2.28  effect prescribed by Minnesota Statutes, sections 16A.631 to 
  2.29  16A.675, and by the Minnesota Constitution, article XI, sections 
  2.30  4 to 7. 
  2.31     Sec. 5.  [ADVISORY COUNCIL.] 
  2.32     Subdivision 1.  [SCOPE.] An advisory council is established 
  2.33  to study statewide land use issues relating to flood mitigation 
  2.34  planning.  The council will: 
  2.35     (1) consider long-range flood hazards on a statewide basis 
  2.36  including land use practices and their effect on flood hazards; 
  2.37     (2) assess flood mitigation measures currently in place; 
  2.38  and 
  2.39     (3) study additional flood mitigation systems and measures 
  2.40  including the cost and probable effectiveness of each 
  2.41  alternative. 
  2.42     Subd. 2.  [COORDINATION.] The commissioners of natural 
  2.43  resources, administration, transportation, public safety, and 
  2.44  any other state department or agency shall, upon request by the 
  2.45  advisory council, provide data that is collected or possessed by 
  3.1   their agencies and that is necessary or useful in conducting the 
  3.2   study and preparing the report required by this section. 
  3.3      Subd. 3.  [REPORT.] The council must report to the 
  3.4   legislature by February 1, 1998, on the results of its study 
  3.5   together with its recommendations for comprehensive statewide 
  3.6   flood mitigation initiatives and appropriations for recommended 
  3.7   projects. 
  3.8      Subd. 4.  [COMPOSITION OF COUNCIL.] The council is composed 
  3.9   of 11 members selected as follows: 
  3.10     (1) the chairs of the environment and natural resources 
  3.11  committee, the agriculture committee, and the capital investment 
  3.12  committee of the house of representatives; 
  3.13     (2) the chairs of the environment and natural resources 
  3.14  committee, the agriculture committee, and the state government 
  3.15  finance committee of the senate; 
  3.16     (3) the director of the division of emergency management of 
  3.17  the department of public safety, or the director's designee; and 
  3.18     (4) two members appointed by the minority leader of the 
  3.19  house of representatives and two members appointed by the 
  3.20  minority leader of the senate. 
  3.21     Subd. 5.  [STAFF.] The department of natural resources, the 
  3.22  emergency management division of the department of public 
  3.23  safety, and legislative staff shall provide administrative and 
  3.24  staff assistance when requested by the advisory council.
