A bill for an act
relating to human services; establishing a task force
on licensing and alternative quality assurance.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin TASK FORCE ON LICENSING AND ALTERNATIVE
QUALITY ASSURANCE.

new text begin Purpose. new text end

new text begin A task force on licensing and
alternative quality assurance is established to explore funding
options to improve and support the Department of Human Services'
licensing and quality assurance system for persons with
developmental disabilities.

new text begin Membership. new text end

new text begin The commissioner of human services,
in consultation with the Minnesota Region 10 Quality Assurance
Commission, shall appoint 15 members to the task force,
including representatives of interested stakeholder groups,
counties, and Department of Human Services staff.

new text begin Task force duties. new text end

new text begin The duties of the task force
on licensing and alternative quality assurance include the
following:

new text begin (1) recommending the specific components for a
comprehensive quality assurance and licensing system;
new text end

new text begin (2) recommending steps for implementation of a
comprehensive statewide quality assurance and licensing system;
new text end

new text begin (3) examining whether an entity outside of the Department
of Human Services can administer a statewide quality assurance
licensing system and exploring the benefits and problems in
using such an independent entity;

new text begin (4) proposing an organizational structure, including
community-based regional implementation for a quality and
licensing system;
new text end

new text begin (5) developing recommendations on the amount and sources of
funding necessary for a statewide quality assurance and
licensing system, including consideration of whether federal
Medicaid administrative funds and a portion of home and
community-based services waiver funds can be used and, if so, to
what extent; and

new text begin (6) developing recommendations on implementation of a
statewide system of quality assurance and licensing for a final
report.

new text begin At a minimum, meetings of the task
force must be conducted according to Minnesota Statutes, chapter
13D. During the 2006-2007 biennium, the task force must meet at
least quarterly.

new text begin The task force shall report to the
legislative committees with jurisdiction over health and human
services with recommendations on implementation of a statewide
system of quality assurance and licensing by December 15, 2006.
