  1.1                          A bill for an act 
  1.2             relating to civil actions; extending the municipal 
  1.3             tort claims protections to nonprofit firefighting 
  1.4             corporations; amending Minnesota Statutes 1994, 
  1.5             section 466.01, subdivisions 1 and 6. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 466.01, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [MUNICIPALITY.] For the purposes of 
  1.10  sections 466.01 to 466.15, "municipality" means any city, 
  1.11  whether organized under home rule charter or otherwise, any 
  1.12  county, town, public authority, public corporation, nonprofit 
  1.13  firefighting corporation, special district, school district, 
  1.14  however organized, county agricultural society organized 
  1.15  pursuant to chapter 38, joint powers board or organization 
  1.16  created under section 471.59 or other statute, public library, 
  1.17  regional public library system, multicounty multitype library 
  1.18  system, other political subdivision, or community action agency. 
  1.19     Sec. 2.  Minnesota Statutes 1994, section 466.01, 
  1.20  subdivision 6, is amended to read: 
  1.21     Subd. 6.  [EMPLOYEE, OFFICER, OR AGENT.] For the purposes 
  1.22  of sections 466.01 to 466.15, "employee," "officer," or "agent" 
  1.23  means a present or former employee, officer, or agent of a 
  1.24  municipality, or other person acting on behalf of the 
  1.25  municipality in an official capacity, temporarily or 
  2.1   permanently, with or without compensation, but does not include 
  2.2   an independent contractor other than a nonprofit firefighting 
  2.3   corporation.  "Employee" includes court administrators and their 
  2.4   staff under chapter 485, district administration staff in the 
  2.5   second and fourth judicial districts, guardians ad litem, and 
  2.6   other employees within the court system whose salaries are paid 
  2.7   by the county, other than employees who remain on the county 
  2.8   payroll under section 480.181, subdivision 2.
