  1.1                          A bill for an act 
  1.2             relating to capital improvements; consolidating the 
  1.3             requirements for University Center Rochester; amending 
  1.4             Laws 1994, chapter 643, section 10, subdivision 10, as 
  1.5             amended. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Laws 1994, chapter 643, section 10, subdivision 
  1.8   10, as amended by Laws 1995, First Special Session chapter 2, 
  1.9   article 1, section 42, is amended to read: 
  1.10  Subd. 10.  Rochester Technical College
  1.11  University Center Rochester                    1,200,000
  1.12  This appropriation is to for predesign 
  1.13  and design of an integrated campus in 
  1.14  accordance with this subdivision.  
  1.15  $600,000 of this appropriation is 
  1.16  available immediately.  The remainder 
  1.17  is available after a master academic 
  1.18  plan has been approved under clause (3) 
  1.19  and the technical college has been 
  1.20  sold., remodeling of student support 
  1.21  facilities, remodeling of facilities 
  1.22  for joint academic programming, and 
  1.23  construction of roads and other 
  1.24  infrastructure to integrate the campus 
  1.25  for delivery of consolidated college, 
  1.26  state university, and University of 
  1.27  Minnesota programs at the University 
  1.28  Center Rochester.  Predesign may 
  1.29  include consideration of codevelopment 
  1.30  of facilities with local units of 
  1.31  government. 
  1.32  (1) The board of trustees of the 
  1.33  Minnesota state colleges and 
  1.34  universities may enter into an 
  1.35  agreement for the sale of the Rochester 
  1.36  Technical College.  The sale is 
  1.37  contingent on the approval of the board 
  1.38  of trustees and a determination by the 
  1.39  board of trustees that the sale is 
  2.1   consistent with its priorities.  The 
  2.2   sale price shall equal the appraised 
  2.3   value if sold to independent school 
  2.4   district No. 535, Rochester, or, if 
  2.5   sold to any other party, the sale price 
  2.6   shall not be less than the appraised 
  2.7   value. 
  2.8   It is the intent of the legislature 
  2.9   that no technical college program 
  2.10  reduction, apart from normal program 
  2.11  review, shall occur as a result of this 
  2.12  sale. 
  2.13  (2) The sale shall not cause the 
  2.14  technical college to lease space or to 
  2.15  move to any temporary site. 
  2.16  (3) Prior to the preparation of design 
  2.17  documents, the post-secondary boards 
  2.18  and the relevant campus staff shall 
  2.19  jointly prepare a master academic plan 
  2.20  for an integrated campus for the 
  2.21  Rochester center facility.  The boards 
  2.22  shall consider the creation of a 
  2.23  polytechnic university.  The plan shall 
  2.24  be submitted for review to the higher 
  2.25  education finance divisions by January 
  2.26  16, 1996, and must be approved by the 
  2.27  legislature before the remaining 
  2.28  $600,000 of the appropriation is 
  2.29  available.  
  2.30  (4) The proceeds from the sale of the 
  2.31  technical college are appropriated for 
  2.32  the design and construction necessary 
  2.33  to integrate technical college programs 
  2.34  into the Rochester center and to add or 
  2.35  modify space where necessary.  The new 
  2.36  technical college program space must be 
  2.37  attached to and must maximize the 
  2.38  current services, space, and programs 
  2.39  of the technical college, community 
  2.40  college, state university, and 
  2.41  University of Minnesota cooperative 
  2.42  campus.  The state board of trustees 
  2.43  may not begin construction of this 
  2.44  project until the legislature has 
  2.45  approved the construction plans. 
  2.46  (5) The state board of trustees shall 
  2.47  develop a plan to relocate to the 
  2.48  Austin, Faribault, and other 
  2.49  Southeastern Minnesota campuses all 
  2.50  Rochester campus programs that are not 
  2.51  essential to the integrated mission 
  2.52  planned for the Rochester center 
  2.53  facility.  This plan must be completed 
  2.54  prior to preparing design documents for 
  2.55  the technical college addition to the 
  2.56  Rochester center. 
  2.57  (6) The state board of trustees shall 
  2.58  consider relocating the horticulture 
  2.59  technology program from the Rochester 
  2.60  campus to the Austin campus of 
  2.61  Riverland technical college before the 
  2.62  start of the 1995-1996 academic year.
