  1.1                          A bill for an act 
  1.2             relating to human services; establishing the older 
  1.3             adult services grant program; funding the moratorium 
  1.4             exception process; appropriating money; proposing 
  1.5             coding for new law in Minnesota Statutes, chapter 256. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [256.9754] [OLDER ADULT SERVICES DEVELOPMENT 
  1.8   GRANTS PROGRAM.] 
  1.9      Subdivision 1.  [DEFINITIONS.] For purposes of this 
  1.10  section, the following terms have the meanings given. 
  1.11     (a) "Community" means a town, township, city, or targeted 
  1.12  neighborhood within a city, or a consortium of towns, townships, 
  1.13  cities, or targeted neighborhoods within cities. 
  1.14     (b) "Eligible county" means a county with a ratio of 
  1.15  nursing facility beds to county residents age 85 and over that 
  1.16  is in the lowest decile of all counties in the state, that has 
  1.17  experienced termination of an older adult service at the time of 
  1.18  or within 12 months prior to application. 
  1.19     (c) "Older adult services" means any services available 
  1.20  under the elderly waiver program or alternative care grant 
  1.21  programs; nursing facility services; transportation services; 
  1.22  respite services; and other community-based services identified 
  1.23  as necessary either to maintain lifestyle choices for older 
  1.24  Minnesotans, or to promote independence. 
  1.25     (d) "Older adult" refers to individuals 65 years of age and 
  2.1   older. 
  2.2      Subd. 2.  [CREATION.] The older adult services grant 
  2.3   program is created under the administration of the commissioner 
  2.4   of human services.  
  2.5      Subd. 3.  [PROVISION OF GRANTS.] The commissioner shall 
  2.6   make grants to establish new older adult services available to 
  2.7   communities, providers of older adult services identified in 
  2.8   subdivision 1, or to a consortium of providers of older adult 
  2.9   services, located within eligible counties.  Grants may be 
  2.10  provided for capital and other costs including, but not limited 
  2.11  to, start-up and training costs, equipment, exceptions to the 
  2.12  moratorium on nursing facility beds under section 144A.073, and 
  2.13  supplies related to the establishment of new older adult 
  2.14  services or other residential or service alternatives to nursing 
  2.15  facility care.  Grants may also be made to renovate current 
  2.16  buildings, provide transportation services, or expand 
  2.17  state-funded programs in the area. 
  2.18     Subd. 4.  [ELIGIBILITY.] Grants may be awarded only to 
  2.19  communities and providers or to a consortium of providers within 
  2.20  eligible counties that have a local match of 50 percent of the 
  2.21  costs for the project in the form of donations, local tax 
  2.22  dollars, in-kind donations, fundraising, or other local match. 
  2.23     Subd. 5.  [GRANT PREFERENCE.] In awarding grants, the 
  2.24  commissioner of human services shall give preference to 
  2.25  applicants that best demonstrate that the recent or expected 
  2.26  termination of an older adult service has significantly reduced, 
  2.27  or will significantly reduce, long-term care choices for older 
  2.28  adults.  Denial of approval of an application in one year does 
  2.29  not preclude submission of an application in a subsequent year.  
  2.30  The maximum grant amount is limited to $1,500,000. 
  2.31     Sec. 2.  [APPROPRIATION.] 
  2.32     (a) $6,000,000 is appropriated from the general fund to the 
  2.33  commissioner of human services for the biennium ending June 30, 
  2.34  2003, to provide grants under section 1.  
  2.35     (b) $....... is appropriated from the general fund to the 
  2.36  commissioner of health for the biennium ending June 30, 2003, to 
  3.1   fund moratorium exception projects under Minnesota Statutes, 
  3.2   section 144A.073 for facilities located in eligible counties, as 
  3.3   defined in Minnesota Statutes, section 256.9754, subdivision 1, 
  3.4   paragraph (b).
