  1.1                          A bill for an act
  1.2             relating to transportation; authorizing the issuance 
  1.3             of state trunk highway bonds for trunk highway 
  1.4             bridges; authorizing the issuance of state 
  1.5             transportation bonds for local bridges. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [ISSUANCE OF TRUNK HIGHWAY BONDS.] 
  1.8      On request of the commissioner of transportation, the 
  1.9   commissioner of finance shall issue and sell Minnesota state 
  1.10  trunk highway bonds for the purposes provided in Minnesota 
  1.11  Statutes, section 167.51, subdivision 1, in the aggregate 
  1.12  principal amount of $30,000,000 in the manner and on the 
  1.13  conditions prescribed in Minnesota Statutes, sections 167.50 and 
  1.14  167.51, and in the Minnesota Constitution, article XIV, section 
  1.15  11.  The proceeds of the bonds must be deposited in the trunk 
  1.16  highway fund for expenditure in accordance with section 3, 
  1.17  subdivision 1. 
  1.18     Sec. 2.  [ISSUANCE OF STATE TRANSPORTATION BONDS.] 
  1.19     On request of the commissioner of transportation, the 
  1.20  commissioner of finance shall issue and sell Minnesota state 
  1.21  transportation bonds for the purposes provided in Minnesota 
  1.22  Statutes, section 174.51, subdivision 1, in the aggregate 
  1.23  principal amount of $35,000,000 in the manner and on the 
  1.24  conditions prescribed in Minnesota Statutes, section 174.51, and 
  1.25  in the Minnesota Constitution, article XI.  The proceeds of the 
  2.1   bonds must be deposited in the Minnesota state transportation 
  2.2   fund for expenditure in accordance with section 3, subdivision 
  2.3   2, and with Minnesota Statutes, section 174.50. 
  2.4      Sec. 3.  [APPROPRIATION AND DISTRIBUTION OF PROCEEDS.] 
  2.5      Subdivision 1.  [TRUNK HIGHWAY BOND PROCEEDS.] $30,000,000, 
  2.6   or so much there as the commissioner of transportation 
  2.7   determines is needed, is appropriated from the trunk highway 
  2.8   fund to the commissioner of transportation for the replacement, 
  2.9   rehabilitation, and repair of key bridges on the state trunk 
  2.10  highway system. 
  2.11     Subd. 2.  [STATE TRANSPORTATION BOND PROCEEDS.] (a) 
  2.12  $35,000,000, or so much thereof as the commissioner of 
  2.13  transportation determines is needed, is appropriated from the 
  2.14  state transportation fund to the commissioner of 
  2.15  transportation.  The commissioner shall spend this appropriation 
  2.16  as grants to political subdivisions for the replacement, 
  2.17  rehabilitation, and repair of key bridges on the state 
  2.18  transportation system.  The commissioner shall make these grants 
  2.19  in accordance with and for the purposes of Minnesota Statutes, 
  2.20  section 174.50. 
  2.21     (b) In making grants under paragraph (a), the commissioner 
  2.22  may not exceed the following limits: 
  2.23     (1) to counties, $.......; 
  2.24     (2) to cities, $.......; and 
  2.25     (3) to towns, $........ 
  2.26     Sec. 4.  [POLITICAL SUBDIVISIONS; USE OF GRANTS.] 
  2.27     Political subdivisions may use grants under section 3, 
  2.28  subdivision 2, for the replacement, rehabilitation, or repair of 
  2.29  bridges, including but not limited to: 
  2.30     (1) matching federal grants for bridge replacement, 
  2.31  rehabilitation, or repair; 
  2.32     (2) paying the costs of abandoning an existing bridge that 
  2.33  is deficient and in need of replacement, but where no 
  2.34  replacement will be made; 
  2.35     (3) paying the costs of constructing a road or street that 
  2.36  would facilitate the abandonment of an existing bridge 
  3.1   determined by the commissioner of transportation to be 
  3.2   deficient, if the commissioner determines that construction of 
  3.3   the road or street is more cost efficient than replacing the 
  3.4   existing bridge; and 
  3.5      (4) paying costs authorized by Minnesota Statutes, section 
  3.6   174.50, subdivision 6a. 
  3.7      Sec. 5.  [EFFECTIVE DATE.] 
  3.8      Sections 1 to 4 are effective July 1, 1996.
