  1.1                          A bill for an act 
  1.2             relating to metropolitan government; abolishing the

  1.35            repealed. 
  1.36  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.37     Section 1.  [473.250] [METROPOLITAN COUNCIL ABOLISHED.] 
  1.38     Effective July 1, 1996, the metropolitan council is 
  1.39  abolished. 
  1.40     Sec. 2.  [473.251] [TRANSITIONAL PERIOD.] 
  2.1      Subdivision 1.  [COUNCIL DUTIES.] As soon as possible after 
  2.2   the effective date of this act, the metropolitan council shall 
  2.3   prepare a summary of its powers and duties and an inventory of 
  2.4   its assets and liabilities of all kinds.  Based upon its summary 
  2.5   and inventory, the council shall submit to the legislature, 
  2.6   before July 1, 1996, a report making recommendations to the 
  2.7   legislature on the following: 
  2.8      (1) proposed alternative successors to the council for 
  2.9   those powers and duties the council concludes must be possessed 
  2.10  by some level of government and that have not been transferred 
  2.11  by law to another entity of government or abolished by July 1, 
  2.12  1996; 
  2.13     (2) proposed alternative dispositions of the council's 
  2.14  assets and liabilities that have not been transferred by law to 
  2.15  another governmental entity by July 1, 1996; and 
  2.16     (3) any other recommendations the council may wish to make 
  2.17  to the legislature to provide an orderly transition from the 
  2.18  governmental status existing before the enactment of this act to 
  2.19  the governmental status which will exist beginning July 1, 1996, 
  2.20  including amendments to, or repeals of, laws relating to the 
  2.21  metropolitan council. 
  2.22     Subd. 2.  [COMMISSIONER OF ADMINISTRATION; POWERS AND 
  2.23  DUTIES.] Powers and duties of the metropolitan council that are 
  2.24  not transferred to another governmental entity or abolished by 
  2.25  law by July 1, 1996, are transferred to the commissioner of the 
  2.26  department of administration who shall continue to exercise 
  2.27  those powers and duties until they are abolished by law or until 
  2.28  July 1, 1997, whichever is later.  Assets and liabilities of the 
  2.29  metropolitan council that have not been disposed of pursuant to 
  2.30  law by July 1, 1996, are transferred to the commissioner of the 
  2.31  department of administration who shall dispose of them pursuant 
  2.32  to law by July 1, 1997.  Section 15.039 applies to the transfer 
  2.33  of the metropolitan council's powers, duties, assets, and 
  2.34  liabilities to the commissioner of administration to the extent 
  2.35  practicable.  By February 15, 1997, the commissioner shall 
  2.36  report to the legislature any recommendations that the 
  3.1   commissioner considers necessary to supplement the metropolitan 
  3.2   council's report and recommendation required by subdivision 1. 
  3.3      Sec. 3.  [BONDS TO BE PAID.] 
  3.4      Notwithstanding the repeal of their authorizing law, bonds 
  3.5   and other obligations of the metropolitan council issued and 
  3.6   outstanding on the effective date of this act must be paid 
  3.7   according to the authorizing law and the terms of the 
  3.8   obligations. 
  3.9      Sec. 4.  [REPEALER.] 
  3.10     Subdivision 1.  Minnesota Statutes 1994, sections 473.121, 
  3.11  subdivisions 3, 8, 10, and 12; 473.123; 473.125; and 473.127, 
  3.12  are repealed effective July 1, 1996.  
  3.13     Subd. 2.  Minnesota Statutes 1994, sections 473.129;

  4.1      Sec. 5.  [APPLICATION.] 
  4.2      This act applies in Anoka, Carver, Dakota, Hennepin, 
  4.3   Ramsey, Scott, and Washington counties. 
  4.4      Sec. 6.  [EFFECTIVE DATE.] 
  4.5      Except as otherwise provided, this act is effective the day 
  4.6   after its final enactment.
