  1.1                          A bill for an act 
  1.2             relating to retirement; authorizing purchase of 
  1.3             service credit in the Minnesota state retirement 
  1.4             system general plan by certain Willmar regional 
  1.5             treatment center employees; repealing Laws 1990, 
  1.6             chapter 570, article 13, section 1, subdivision 5. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [PURCHASE OF PRIOR SERVICE CREDIT, WILLMAR 
  1.9   REGIONAL TREATMENT CENTER EMPLOYEES.] 
  1.10     Subdivision 1.  [ELIGIBILITY.] (a) Notwithstanding any 
  1.11  provision of Minnesota Statutes, section 352.01, subdivision 11, 
  1.12  to the contrary, an eligible person described in paragraph (b) 
  1.13  is entitled to purchase allowable service credit in the 
  1.14  Minnesota state retirement system general plan for the period 
  1.15  described in paragraph (c) by paying the amount specified in 
  1.16  subdivision 2. 
  1.17     (b) An eligible person is a person who: 
  1.18     (1) is a current member of the Minnesota state retirement 
  1.19  system general plan; 
  1.20     (2) is currently employed by the Willmar Regional Treatment 
  1.21  Center; 
  1.22     (3) resigned from state service in order to attend the 
  1.23  University of Michigan, Ann Arbor, between January 1967 and 
  1.24  April 1968 and received a stipend from the Minnesota department 
  1.25  of welfare during this period; and 
  1.26     (4) was reemployed by that department with a requirement 
  2.1   that the individual provide a minimum period of additional 
  2.2   service. 
  2.3      (c) The period of service credit purchase is one year, 
  2.4   beginning with the start of the schooling or training in 
  2.5   paragraph (b), clause (3). 
  2.6      Subd. 2.  [PURCHASE PAYMENT AMOUNT.] (a) To purchase 
  2.7   service credit for the period specified in subdivision 1, 
  2.8   paragraph (c), an eligible individual must pay to the Minnesota 
  2.9   state retirement system general plan an amount computed under 
  2.10  Minnesota Statutes, section 352.01, subdivision 11, clause (9), 
  2.11  except that the applicable contribution rates and the employee 
  2.12  salary rate are those in effect upon reemployment after the 
  2.13  period of schooling.  Interest charges must be computed from the 
  2.14  date of reemployment until paid. 
  2.15     (b) To be entitled to make the payment specified in 
  2.16  paragraph (a), the individual must establish in the records of 
  2.17  the retirement plan that the eligibility requirements in 
  2.18  subdivision 1 are satisfied.  The manner of proof must be in 
  2.19  accordance with procedures prescribed by the executive director 
  2.20  of the Minnesota state retirement system. 
  2.21     Subd. 3.  [PURCHASE PAYMENT FORM.] The purchase payment 
  2.22  amount under subdivision 2 is payable by an eligible individual 
  2.23  under subdivision 1 within 180 days of the effective date of 
  2.24  this section, or prior to retirement from the Minnesota state 
  2.25  retirement system general plan, whichever is earlier. 
  2.26     Subd. 4.  [SERVICE CREDIT GRANT.] Service credit for the 
  2.27  purchase period must be granted to the account of the eligible 
  2.28  person upon receipt of the purchase payment amount specified in 
  2.29  subdivision 2. 
  2.30     Sec. 2.  [REPEALER.] 
  2.31     Laws 1990, chapter 570, article 13, section 1, subdivision 
  2.32  5, is repealed. 
  2.33     Sec. 3.  [EFFECTIVE DATE.] 
  2.34     Sections 1 and 2 are effective the day following final 
  2.35  enactment.
