A bill for an act
relating to natural resources; requiring an elk management plan.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin ELK MANAGEMENT PLAN.

new text begin (a) By July 31, 2009, the commissioner of natural resources shall:
new text end

new text begin (1) develop an elk management plan;
new text end

new text begin (2) present the elk management plan to the Kittson, Marshall, and Roseau County
Boards; and
new text end

new text begin (3) begin implementing the plan.
new text end

new text begin (b) If the commissioner fails to meet all the requirements in paragraph (a), the
commissioner shall implement the following elk management strategies:
new text end

new text begin (1) establish an open season for elk in Kittson, Marshall, and Roseau Counties to
begin in 2009 and continue until the elk population reaches 55 or less; and
new text end

new text begin (2) fence all properties of property owners in Roseau, Kittson, and Marshall
Counties that request fencing.
