A bill for an act
relating to natural resources; requiring an elk management plan.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. ELK MANAGEMENT PLAN.

(a) By July 31, 2009, the commissioner of natural resources shall:

(1) develop an elk management plan;

(2) present the elk management plan to the Kittson, Marshall, and Roseau County
Boards; and

(3) begin implementing the plan.

(b) If the commissioner fails to meet all the requirements in paragraph (a), the
commissioner shall implement the following elk management strategies:

(1) establish an open season for elk in Kittson, Marshall, and Roseau Counties to
begin in 2009 and continue until the elk population reaches 55 or less; and

(2) fence all properties of property owners in Roseau, Kittson, and Marshall
Counties that request fencing.

EFFECTIVE DATE.

This section is effective the day following final enactment.
