A bill for an act
relating to data practices; requiring government entities to share personnel data
in certain circumstances; amending Minnesota Statutes 2010, section 13.43, by
adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2010, section 13.43, is amended by adding a subdivision
to read:

new text begin Intergovernmental access to personnel data. new text end

new text begin Except where
dissemination is otherwise restricted by a provision of federal or state law, or by the
terms of a collective bargaining agreement, private personnel data, including results of
background investigations, on a current or former employee of a government entity must
be disseminated to another government entity upon request, if the request is made because
the subject of the data is an applicant for employment with the requesting government
entity.
