  1.1                          A bill for an act 
  1.2             relating to retirement; modifying a deadline for 
  1.3             making certain payments for pension service credit for 
  1.4             certain teachers; amending Laws 1995, chapter 262, 
  1.5             article 1, section 16. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Laws 1995, chapter 262, article 1, section 16, 
  1.8   is amended to read: 
  1.9      Sec. 16.  [RETROACTIVE PROVISIONS.] 
  1.10     (a) A teacher who had at least three years of allowable 
  1.11  service credit under Minnesota Statutes, chapter 354 or 354A, on 
  1.12  July 1, 1994, and who worked part-time between July 1, 1994, and 
  1.13  June 30, 1995, may be allowed to make contributions to and 
  1.14  accrue allowable service credit in the applicable retirement 
  1.15  fund, as if the teacher had been working full time, as provided 
  1.16  in Minnesota Statutes, sections 354.66, subdivision 4, and 
  1.17  354A.094, subdivision 4, for service after July 1, 1994, and 
  1.18  before June 30, 1995.  If a teacher described in this paragraph 
  1.19  wishes to obtain allowable service credit as if the teacher had 
  1.20  been working full time for the period from July 1, 1994, to June 
  1.21  30, 1995, the teacher must: 
  1.22     (1) make a lump sum payment to the applicable pension 
  1.23  fund within 60 days after the effective date of this section 
  1.24  before August 2, 1996, with respect to the St. Paul teachers 
  1.25  retirement fund association, or before August 2, 1995, with 
  2.1   respect to any other teacher retirement plan, of the difference 
  2.2   between the amount of the employer and employee contributions to 
  2.3   the pension fund that would have been paid if the teacher had 
  2.4   been working full time, and that amount that was actually paid 
  2.5   for part-time service during that period; and 
  2.6      (2) submit to the association a letter or other document 
  2.7   from the board of the teacher's employing district stating that 
  2.8   the board would have agreed to the teacher's participation in 
  2.9   the part-time mobility program during the 1994-1995 school year 
  2.10  but for the requirement then in effect that the district make 
  2.11  the full employer contribution to the retirement fund for 
  2.12  teachers with 20 or more years of service based on the 
  2.13  compensation that would have been paid if the teacher had been 
  2.14  employed on a full-time basis. 
  2.15     (b) An employer of a teacher covered by paragraph (a) must 
  2.16  notify the teacher of the option available under paragraph (a) 
  2.17  in writing within 30 days of the effective date of this 
  2.18  section before July 3, 1996, with respect to the St. Paul 
  2.19  teachers retirement fund association, or before July 3, 1995, 
  2.20  with respect to any other teacher retirement plan. 
  2.21     Sec. 2.  [EFFECTIVE DATE.] 
  2.22     Section 1 is effective on the day following final enactment.
