A bill for an act
relating to early childhood education; requiring a unique identification number to
be assigned to all Minnesota children upon enrollment; proposing coding for new
law in Minnesota Statutes, chapter 119B.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

identification number, as defined by the commissioner of education, shall be assigned to
each child upon enrollment in an early childhood education or child care program under
chapter 119A, 119B, or 124D. The commissioners of education and human services shall
work together in order to assign these identification numbers within the specified time.

new text begin The commissioner of education shall collect from
early childhood education and child care programs data including, but not limited to,
demographic, socioeconomic, participation, and assessment information related to
program participants.

new text begin A parent or guardian shall receive information
about the intended use of the numbers and any data collected in connection with the
number by the commissioner of education, the person or agencies who will have access
to the numbers and data, and the right of a parent or guardian to delay the assignment of
an individual identification number to the child until the child enrolls in kindergarten. A
request to delay assignment of a student identification number must be made in writing and
signed by the child's parent or guardian. The request must be filed with the commissioner
of education. The commissioner shall prescribe a form for this purpose.

new text begin Data collected and stored using the student identification
number, including the number itself, are private data on individuals, as defined by section
13.02, subdivision 12. Individual data must be reported to the commissioner of education
by early childhood education and child care programs once a child has enrolled. An early
childhood education or child care program serving children from birth to kindergarten
enrollment must provide individual and summary data to the commissioner of education
on an annual basis for the purposes of developing early childhood educational programs
to meet the individual needs of children and assessing program quality. Private early
childhood education and child care programs must provide individual and summary data
to the commissioner of education upon request. The commissioner of human services and
any early childhood education or child care program required to collect data under this
section may share the data with the commissioner of education for the purposes described
in this subdivision. No data on an individual shall be disclosed to the commissioner of
education without the consent of that individual's parent or guardian.
