  1.1                          A bill for an act
  1.2             relating to education; modifying the compensatory 
  1.3             education revenue program; amending Minnesota Statutes 
  1.4             1994, section 124A.28. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1994, section 124A.28, is 
  1.7   amended to read: 
  1.8      124A.28 [COMPENSATORY EDUCATION REVENUE.] 
  1.9      Subdivision 1.  [USE OF THE REVENUE.] The compensatory 
  1.10  education revenue under section 124A.22, subdivision 3, may be 
  1.11  used to provide eligible services to eligible pupils according 
  1.12  to section 124.311, subdivisions 3 and 4.  It also may must be 
  1.13  used to meet the educational needs of pupils whose educational 
  1.14  achievement is below the level that is appropriate for pupils of 
  1.15  their age.  These needs may be met by providing at least some of 
  1.16  the following: 
  1.17     (1) direct instructional services under the assurance of 
  1.18  mastery program according to section 124.311; 
  1.19     (2) remedial instruction in reading, language arts, and 
  1.20  mathematics to improve the achievement level of these pupils; 
  1.21     (2) (3) additional teachers and teacher aides to provide 
  1.22  more individualized instruction to these pupils; 
  1.23     (3) (4) summer programs that enable these pupils to improve 
  1.24  their achievement or that reemphasize material taught during the 
  1.25  regular school year; 
  2.1      (4) (5) in-service education for teachers, teacher aides, 
  2.2   principals, and other personnel to improve their ability to 
  2.3   recognize these pupils and provide appropriate responses to the 
  2.4   pupils' needs; 
  2.5      (5) (6) for instructional material for these pupils 
  2.6   including:  textbooks, workbooks, periodicals, pamphlets, 
  2.7   photographs, reproductions, filmstrips, prepared slides, 
  2.8   prerecorded video programs, sound recordings, desk charts, 
  2.9   games, study prints and pictures, desk maps, models, learning 
  2.10  kits, blocks and cubes, flashcards, instructional computer 
  2.11  software programs, pencils, pens, crayons, notebooks, 
  2.12  duplicating fluids, and papers; 
  2.13     (6) (7) programs to reduce truancy, encourage completion of 
  2.14  high school, enhance self-concept, provide health services, 
  2.15  provide nutrition services, provide a safe and secure learning 
  2.16  environment, provide coordination for pupils receiving services 
  2.17  from other governmental agencies, provide psychological services 
  2.18  to determine the level of social, emotional, cognitive, and 
  2.19  intellectual development, and provide counseling services, 
  2.20  guidance services, and social work services; and 
  2.21     (7) (8) bilingual programs, bicultural programs, and 
  2.22  programs for pupils of limited English proficiency; and 
  2.23     (9) extended school day and extended school year programs.  
  2.24     Subd. 1a.  [BUILDING ALLOCATION.] A district must 
  2.25  consider allocate the compensatory revenue that it receives to 
  2.26  each school building in direct proportion to the concentration 
  2.27  of children from low-income families in each school building in 
  2.28  the district when allocating compensatory revenue. 
  2.29     Subd. 2.  [SEPARATE ACCOUNTS.] Each district that receives 
  2.30  compensatory education revenue shall maintain separate accounts 
  2.31  to identify expenditures for salaries and programs related to 
  2.32  this revenue. 
  2.33     Subd. 3.  [ANNUAL EXPENDITURE REPORT.] Each year a district 
  2.34  that receives compensatory education revenue shall submit a 
  2.35  report identifying the expenditures it incurred in providing 
  2.36  compensatory education to the pupils described in subdivision 
  3.1   1.  The report must conform to uniform financial and reporting 
  3.2   standards established for this purpose. 
  3.3      Subd. 4.  [ANNUAL STUDENT ASSESSMENT.] Each year, a school 
  3.4   district that receives compensatory revenue shall submit a 
  3.5   report to the department showing the change at each school site 
  3.6   in student achievement for students who have received services 
  3.7   under subdivision 1. 
  3.8      Sec. 2.  [EFFECTIVE DATE.] 
  3.9      Section 1 is effective July 1, 1996.
