relating to state government; providing four percent
salary decreases for legislators and constitutional
officers; proposing coding for new law in Minnesota
Statutes, chapter 15A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Legislators. new text end

new text begin The salary for legislators
is decreased by four percent, effective July 1, 2005.

new text begin Constitutional officers. new text end

new text begin The salary for each of
the following officials is decreased by four percent, effective
July 1, 2005: governor, lieutenant governor, attorney general,
secretary of state, state auditor, and treasurer.

new text begin Effect on other compensation. new text end

new text begin (a)
Notwithstanding sections 85A.02, subdivision 5a, 116O.04,
subdivision 1, and 349A.02, subdivision 1, or other law to the
contrary, the salary of a state employee, other than the
officials specified in subdivision 2, must not be decreased from
the amount paid on the effective date of this section as a
result of subdivision 2.

new text begin (b) Notwithstanding section 43A.17, subdivision 9, the
compensation of a political subdivision employee on the
effective date of this section that would exceed 95 percent of
the salary of the governor as a result of subdivision 2 must not
be decreased as a result of subdivision 2.

new text begin Effect on compensation council recommendations.

new text begin Notwithstanding section 15A.082, the Compensation Council shall
submit salary recommendations that comply with this section.

Sec. 2. new text begin EFFECTIVE DATE.

new text begin Section 1, subdivisions 1 to 3, are effective July 1, 2005.
Section 1, subdivision 4, is effective the day following final
enactment and applies to the Compensation Council
recommendations that are due on May 1, 2005, under Minnesota
Statutes, section 15A.082, subdivision 3.
