A bill for an act
relating to the military; providing unpaid leave of absence from employment for
an immediate family member of a person ordered into active military service
during a time of war or other national emergency; amending Minnesota Statutes
2008, section 181.948, subdivision 2.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 181.948, subdivision 2, is amended to read:


Subd. 2.

Unpaid leave required.

Unless the leave would unduly disrupt the
operations of the employer, an employer shall grant a leave of absence without pay
to an employee whose immediate family member, as a member of the United States
armed forces, has been ordered into active service in support of a war or other national
emergencydeleted text begin .deleted text end new text begin , for any of the following purposes, broadly construed:

new text begin (1) to attend to personal or family financial or legal matters affected by the
deployment;
new text end

new text begin (2) to arrange for the care of children affected by the deployment, including but not
limited to matters of child care, medical care, and educational services for the children;

new text begin (3) to acquire or comply with medical care including, but not limited to, counseling
services and rest or recuperation for physical or emotional stresses or other health-related
conditions caused or affected by the deployment;

new text begin (4) to attend to real and personal property matters affected by the deployment; and
new text end

new text begin (5) to spend time with the deploying family member prior to, during, or following
the person's military deployment.

new text begin An employer may limit for any employee the cumulative amount of leave for an
employee, as required under this subdivision, to a total of 12 weeks in any 12-month
period.

subdivision to the actual time necessarynew text begin , in any authorized instance,new text end for the employee to
