A bill for an act
relating to construction codes; requiring automatic external defibrillators in
certain structures; amending Minnesota Statutes 2008, section 326B.106, by
adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 326B.106, is amended by adding a
subdivision to read:

new text begin (a) Beginning January 1, 2012, the
code must require the following structures to have an approved and operational automatic
external defibrillator on the premises:

new text begin (1) all state, municipal, and local government buildings with more than 25 people
working in the building;
new text end

new text begin (2) each apartment building that contains more than 72 rental units or is part of
a complex with 72 or more rental units;
new text end

new text begin (3) all public or private nursing homes, as defined in section 144A.01; and
new text end

new text begin (4) all veterans homes, as defined in section 198.001.

new text begin (b) The commissioner shall adopt rules, in consultation with the Department of
Health, that include, without limitation, provisions regarding adequate training on the use
of automatic external defibrillators, the type of device required for each location, placement
of the device in the structure, inspection procedures, and maintenance of the device.

meaning given in section 604A.01.
