A bill for an act
relating to education finance; authorizing an
equalized aid and levy for certain unfunded pupil
transportation costs; amending Minnesota Statutes
2004, section 123B.92, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 123B.92, is
amended by adding a subdivision to read:

new text begin Pupil transportation revenue.new text end

new text begin (a) A school
board is eligible for pupil transportation revenue equal to the
sum of certain bus depreciation costs as defined in paragraph
(b) and the estimated amounts necessary for pupil transportation
costs not otherwise reimbursed in each of the following
categories:

new text begin (1) extraordinary hazardous transportation;
new text end

new text begin (2) special education pupil transportation;
new text end

new text begin (3) pupil transportation to and from area learning centers;
new text end

new text begin (4) pupil transportation to and from programs serving
English language learners;
new text end

new text begin (5) pupil transportation of school-age parents and their
children to and from school;
new text end

new text begin (6) charter school pupil transportation;
new text end

new text begin (7) nonpublic pupil transportation;
new text end

new text begin (8) pupil transportation to and from programs operating a
flexible learning year program;
new text end

new text begin (9) pupil transportation to and from programs offering
extended learning year services;
new text end

new text begin (10) noon kindergarten transportation;
new text end

new text begin (11) pupil transportation to and from kindergarten
preparation programs; and
new text end

new text begin (12) pupil transportation costs of homeless pupils to and
from school.

new text begin (b) A school board's bus depreciation revenue equals the
sum of:
new text end

new text begin (1) 2.7 percent of the district's total school bus fleet
depreciation amount as of June 30 of that year; and
new text end

new text begin (2) 2.7 percent of 10.7 percent of amount of contracted bus
services for, to, and from school pupil transportation. For a
school district that operates a district-owned school bus, the
entire amount earned under this paragraph must be reserved for
the purchase of new buses.

new text begin (c) In order to qualify for revenue under this subdivision,
a school district must submit all necessary information to the
Department of Education in the form and manner specified by the
department.

new text begin (d) A school district's pupil transportation levy equals
the district's pupil transportation revenue computed under this
subdivision multiplied by the lesser of one or the ratio of:

new text begin (1) the quotient derived by dividing the adjusted net tax
capacity of the district for the year preceding the year the
levy is certified, by the adjusted marginal cost pupil in the
district for the school year to which the levy is attributable;

new text begin (2) 150 percent of statewide average adjusted net tax
capacity per pupil unit for the same year.

new text begin (e) A school district's pupil transportation aid is the
difference between its revenue under paragraph (a) and its levy
under paragraph (d).
