  1.1                          A bill for an act 
  1.2             relating to waste management; increasing the amount of 
  1.3             the waste disposal fee that cities or towns may 
  1.4             collect within the metropolitan area; amending 
  1.5             Minnesota Statutes 2000, section 115A.921, subdivision 
  1.6             1. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 115A.921, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [MIXED MUNICIPAL SOLID WASTE.] A city or 
  1.11  town outside the metropolitan area may impose a fee, not to 
  1.12  exceed $1 per cubic yard of waste, or its equivalent, on 
  1.13  operators of facilities for the disposal of mixed municipal 
  1.14  solid waste located within the city or town.  A city or town in 
  1.15  the metropolitan area may impose a fee, not to exceed $1.20 per 
  1.16  cubic yard of waste, or its equivalent, on operators of 
  1.17  facilities for the disposal of mixed municipal solid waste 
  1.18  located within the city or town.  The revenue from the fees must 
  1.19  be credited to the city or town general fund.  Revenue produced 
  1.20  by 25 cents of the fee must be used only for purposes of 
  1.21  landfill abatement or for purposes of mitigating and 
  1.22  compensating for the local risks, costs, and other adverse 
  1.23  effects of facilities.  Revenue produced by the balance of the 
  1.24  fee may be used for any general fund purpose.  
  1.25     Waste residue from recycling facilities at which recyclable 
  1.26  materials are separated or processed for the purpose of 
  2.1   recycling, or from energy and resource recovery facilities at 
  2.2   which solid waste is processed for the purpose of extracting, 
  2.3   reducing, converting to energy, or otherwise separating and 
  2.4   preparing solid waste for reuse shall be exempt from the fee 
  2.5   imposed by a city or town under this section if there is at 
  2.6   least an 85 percent weight reduction in the solid waste 
  2.7   processed.  Before any fee is reduced, the verification 
  2.8   procedures of section 473.843, subdivision 1, paragraph (c), 
  2.9   must be followed and submitted to the appropriate city or town, 
  2.10  except that for facilities operating outside of the metropolitan 
  2.11  area the commissioner shall prescribe procedures for verifying 
  2.12  the required 85 percent weight reduction.
