A bill for an act
relating to human services; requiring review of stay of civil commitment
as alternative to commitment to secure treatment facility for sex offenders;
requiring report.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin The commissioners of human services and public safety shall review the needs and
barriers to the safe and effective use of a stay of commitment or similar arrangement as
an alternative to commitment to a secure treatment facility in appropriate sex offender
civil commitment cases. Before the 2013 legislative session, the commissioners shall
provide the results of the review to the chairs of the house of representatives and senate
committees having jurisdiction over public safety policy, human services policy, human
services reform, and judiciary. The commissioners shall identify the parties responsible for
the supervision, housing, and treatment of individuals placed on a stay of commitment or a
similar arrangement. The commissioners shall indicate any statutory changes necessary to
facilitate use of a stay of commitment or other arrangement while ensuring public safety.
