A bill for an act
relating to health; modifying medical assistance
coverage of cesarean sections; amending Minnesota
Statutes 2004, section 256B.0625, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 256B.0625, is
amended by adding a subdivision to read:

new text begin Medical assistance covers
cesarean sections only in cases of a medical emergency or if two
medical professionals sign a statement authorizing the
procedure. For purposes of this requirement, a "medical
emergency" exists if continuing labor without performing a
cesarean section would:

new text begin (1) place the health of the mother, or health of the child
being delivered, in serious jeopardy;
new text end

new text begin (2) cause serious impairment to body functions of the
mother or child; or
new text end

new text begin (3) cause serious dysfunction of any bodily organ or part
of the mother or child.

new text begin For purposes of this requirement, "medical professional" means a
medical doctor, doctor of osteopathy, certified nurse midwife,
or OB/GYN nurse practitioner.
