  1.1                          A bill for an act
  1.2             relating to education; permitting a school district to 
  1.3             not comply with a state mandate under certain 
  1.4             conditions; proposing coding for new law in Minnesota 
  1.5             Statutes, chapter 126. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [126.116] [NO MANDATES WITHOUT MONEY.] 
  1.8      A school district is not required to comply with a state 
  1.9   mandate, as defined in section 3.881, if the mandate affects the 
  1.10  daily operation of schools, the authority of school boards to 
  1.11  establish locally developed education policies, changes in the 
  1.12  school district's curriculum, or other changes in the school 
  1.13  district's spending priorities until the additional revenue 
  1.14  needed to pay for the mandate is identified.  To be exempt from 
  1.15  a mandate under this section, a school board must:  
  1.16     (1) identify the state mandates; 
  1.17     (2) hold a public hearing on the exemption from these state 
  1.18  mandates; and 
  1.19     (3) by unanimous vote of the school board adopt a 
  1.20  resolution exempting the school district from the specific state 
  1.21  mandates. 
  1.22     Sec. 2.  [EFFECTIVE DATE.] 
  1.23     Section 1 is effective July 1, 1995, and applies to new or 
  1.24  increased state mandates that are effective after June 30, 1995.
