A bill for an act
relating to public safety; requiring Department of Public Safety to support
development of statewide planning, mapping, drawings, and schematic system
for public schools; proposing coding for new law in Minnesota Statutes, chapter
12.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

SCHEMATIC SYSTEM.

new text begin The Department of Public Safety shall support
development of a statewide planning, mapping, drawings, and schematic system for public
schools in this state for use by response agencies who are called to respond to an act of
terrorism, a pandemic disease outbreak, or related emergency.

new text begin Guidelines. new text end

new text begin The statewide planning, mapping, drawings, and schematic
system must include, without limitation:
new text end

new text begin (1) the type of information that must be included within the software program that
comprises the system, including without limitation up-to-date scalable floor plans, fire
protection information, security and emergency medical equipment, building evacuation
plans, utility information, known building hazards, and information on how to contact
emergency personnel in real time through visual electronic media;

new text begin (2) compliance by participating districts with state agency guidelines;
new text end

new text begin (3) the manner by which the information prescribed in clause (1) must be transferred
to the statewide system from the school districts and political subdivisions that participate
in the system;

new text begin (4) standards for the software that must be used by the participating school districts
and political subdivisions that participate in the statewide system;
new text end

new text begin (5) conditions for use of the statewide system by response agencies;
new text end

new text begin (6) guidelines for:
new text end

new text begin (i) the accessibility and confidentiality of information contained within the statewide
system; and
new text end

new text begin (ii) the incorporation, in connection with the use of the statewide system, of the
items described in subdivision 3, paragraph (a), clause (2);

new text begin (7) in accordance with information obtained by the department, determination of the
priority for distribution of any money that may be available for the school districts and
political subdivisions to participate in the statewide system; and

new text begin (8) guidelines recommended by the department for training persons employed by
response agencies concerning the use of the statewide system.

new text begin Subd. 3. new text end

new text begin Participation by school districts and political subdivisions. new text end

new text begin (a) To the
extent money is made available, school districts and political subdivisions shall:
new text end

new text begin (1) participate in the statewide planning, mapping, drawings, and schematic system;
and
new text end

new text begin (2) incorporate into their use of the statewide system, without limitation:
new text end

new text begin (i) evacuation routes and strategies for evacuation;
new text end

new text begin (ii) alarms and other signals or means of notification;
new text end

new text begin (iii) plans for sheltering in place;
new text end

new text begin (iv) zoning of buildings for triage in the event of a pandemic outbreak of influenza
or other disease, and infection; and
new text end

new text begin (v) training and strategies for prevention in connection with attacks involving
violence.

new text begin (b) If a school district or a political subdivision uses its own planning, mapping,
drawings, and schematic system before the department establishes guidelines for a
statewide planning, mapping, drawings, and schematic system, the school district or
political subdivision may continue to use its system unless money is made available for
the school district or political subdivision to update or modify its system as necessary for
compliance with the statewide system guidelines.

new text begin (a) The department shall pursue any money that may be available
from the federal government for developing guidelines for a statewide planning, mapping,
drawings, and schematic system for operating the statewide system by public schools and
supporting districts, by distributing grants to school districts, political subdivisions, and
first responders that participate in the statewide system.

new text begin (b) The department may accept gifts, grants, and contributions for developing
and supporting a statewide system and distribute funds to school districts and political
subdivisions that participate in the statewide system.

new text begin (c) On or before July 1, 2008, and on or before July 1 of each year thereafter,
each school district and political subdivision that participates in the statewide system
shall submit to the department a progress report setting forth, in accordance with rules
adopted by the department, the experience of the school district or political subdivision, as
applicable, with respect to its participation in the statewide system. The department shall
receive and process these progress reports and provide to the legislature a summarized
overview of the statewide system on or before October 1, 2008, and on or before October
1 of each year thereafter.

new text begin For purposes of this section:

new text begin (a) "Act of terrorism" means a terroristic threat directed at a school in violation of
section 609.713 or a crime committed in furtherance of terrorism in violation of section
609.714.

new text begin (b) "Political subdivision" means a county, statutory or home rule charter city,
town, or school district.

new text begin (c) "Real time" means the actual time during which something takes place.

new text begin (d) "Response agency" means a fire department or company, law enforcement
official or office, an ambulance or other emergency rescue service, the 911 emergency and
public safety communications systems established under chapter 403, or the Division of
Emergency Management created in section 12.04, subdivision 1.

new text begin (e) "Sheltering in place" means to remain inside a building, room, structure, or
other location during an emergency when egress may be impossible or when egress
may present a more substantial risk than remaining inside the building, room, structure,
or other location, as applicable.

new text begin (f) "Statewide system" refers to the statewide planning, mapping, drawings, and
schematic system.

new text begin The commissioner of public safety shall submit
a report to the legislature by February 2, 2008, on the means, progress, and costs of
implementing and maintaining a statewide planning, mapping, drawings, and schematic
system for public schools.
