  1.1                          A bill for an act
  1.2             relating to human services; authorizing a waiver of 
  1.3             statute and rule to permit the direct payment of child 
  1.4             support for children whose fathers are participating 
  1.5             in the FATHER welfare-to-work demonstration project; 
  1.6             appropriating money. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [FATHER PROJECT; TIME-LIMITED WAIVER OF 
  1.9   EXISTING STATUTORY PROVISIONS.] 
  1.10     The commissioner of human services shall waive the 
  1.11  enforcement of any existing specific statutory program 
  1.12  requirements, administrative rules, and standards, including the 
  1.13  relevant provisions of the following sections of Minnesota 
  1.14  Statutes: 
  1.15     (1) 256.741, subdivision 2, paragraph (a); 
  1.16     (2) 256J.30, subdivision 11; 
  1.17     (3) 256J.33, subdivision 4, clause (5); and 
  1.18     (4) 256J.34, subdivision 1, paragraph (d). 
  1.19  The waivers permitted under this section are for the limited 
  1.20  purposes of allowing the entire amount of direct child support 
  1.21  payments to be passed through for the children of individuals 
  1.22  participating in the FATHER project and excluding any direct 
  1.23  child support payments paid by participants in the FATHER 
  1.24  project as income under the MFIP program for individuals 
  1.25  receiving the child support payments who also receive MFIP 
  1.26  assistance.  The waiver authority granted by this section 
  2.1   sunsets on July 1, 2002. 
  2.2      Sec. 2.  [APPROPRIATION.] 
  2.3      $....... is appropriated from the general fund to the 
  2.4   commissioner of human services for the biennium ending June 30, 
  2.5   2001, to offset the increased costs to the state of implementing 
  2.6   the waivers under section 1.  This appropriation is available 
  2.7   until expended and is available only to the extent that it is 
  2.8   matched on a dollar-for-dollar basis by money provided by the 
  2.9   private philanthropical community.
