  1.1                          A bill for an act 
  1.2             relating to state government; regulating rulemaking; 
  1.3             requiring agencies to publish a notice of solicitation 
  1.4             within 60 days of the effective date of new rulemaking 
  1.5             grants of authority; amending Minnesota Statutes 1994, 
  1.6             section 14.10. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 14.10, is 
  1.9   amended to read: 
  1.10     14.10 [SOLICITATION OF OUTSIDE INFORMATION.] 
  1.11     When an agency seeks to obtain information or opinions in 
  1.12  preparing to propose the adoption, amendment, suspension, or 
  1.13  repeal of a rule from sources outside of the agency, the agency 
  1.14  shall publish notice of its action in the State Register, mail 
  1.15  this notice to persons who have registered their names pursuant 
  1.16  to section 14.14, subdivision 1a, 14.22, or 14.30, and afford 
  1.17  all interested persons an opportunity to submit data or views on 
  1.18  the subject of concern in writing or orally.  Such notice and 
  1.19  any written material received by the agency shall become a part 
  1.20  of the rulemaking record to be submitted to the administrative 
  1.21  law judge under section 14.14, 14.26, or 14.32.  This notice 
  1.22  must contain a summary of issues that may be considered by the 
  1.23  agency when the rule is proposed, a statement of the agency's 
  1.24  intentions regarding the formation of an advisory task force on 
  1.25  the subject, and, if a task force is to be formed, a list of the 
  1.26  persons or associations the agency intends to invite to serve on 
  2.1   the task force.  The notice must also include a proposed 
  2.2   timetable outlining when the agency intends to form the advisory 
  2.3   task force, when it could be expected to complete its work, and 
  2.4   how long the agency anticipates the rulemaking process taking. 
  2.5      An agency shall also publish the notice required by this 
  2.6   section within 60 days after the effective date of a law 
  2.7   authorizing or requiring rulemaking by the agency. 
  2.8      Sec. 2.  [EFFECTIVE DATE; APPLICATION.] 
  2.9      Section 1 is effective the day following final enactment 
  2.10  and applies to laws authorizing or requiring rulemaking finally 
  2.11  enacted on or after that date.
