  1.1                          A bill for an act 
  1.2             relating to traffic regulations; authorizing certain 
  1.3             personnel of the department of public safety to stop 
  1.4             motor vehicles under certain circumstances; amending 
  1.5             Minnesota Statutes 1996, section 299D.06. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 299D.06, is 
  1.8   amended to read: 
  1.9      299D.06 [INSPECTIONS; WEIGHING.] 
  1.10     (a) Personnel to enforce the laws relating to motor vehicle 
  1.11  equipment, school bus equipment, drivers license, motor vehicle 
  1.12  registration, motor vehicle size and weight, and motor vehicle 
  1.13  petroleum tax, to enforce public utilities commission rules 
  1.14  relating to motor carriers, to enforce pollution control agency 
  1.15  rules relating to motor vehicle noise abatement, and to enforce 
  1.16  laws relating to directing the movement of vehicles shall be 
  1.17  classified employees of the commissioner of public safety 
  1.18  assigned to the division of state patrol. 
  1.19     (b) Employees engaged in these duties, while actually on 
  1.20  the job during their working hours only, shall have power to: 
  1.21     (1) stop a motor vehicle upon probable cause to inspect it 
  1.22  or enforce the laws and rules described in this section, when 
  1.23  the vehicle has a gross vehicle weight of more than 10,000 
  1.24  pounds, is designed to transport more than 15 passengers 
  1.25  including the driver, or is used in the transportation of 
  2.1   hazardous materials in a quantity requiring placarding under 
  2.2   section 221.033; 
  2.3      (2) issue citations in lieu of arrest and continued 
  2.4   detention; and to 
  2.5      (3) prepare notices to appear in court for violation of 
  2.6   these laws and rules, in the manner provided in section 169.91, 
  2.7   subdivision 3. 
  2.8   They shall not be armed and shall have none of the other powers 
  2.9   and privileges reserved to peace officers.
