  1.1                          A bill for an act
  1.2             relating to education; providing for purchase, sale, 
  1.3             lease, and transfer of land parcels operated under the 
  1.4             authority of the Minnesota state colleges and 
  1.5             universities. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [BOARD AUTHORITY TO PURCHASE, SELL, TRANSFER, 
  1.8   LEASE, AND CONVEY CERTAIN LAND AND IMPROVEMENTS.] 
  1.9      Subdivision 1.  [AUTHORITY.] The board of trustees may 
  1.10  purchase, sell, transfer, lease, and convey land and 
  1.11  improvements described in this section, and may retain all 
  1.12  proceeds from the sale or lease of real estate under Minnesota 
  1.13  Statutes, section 136F.71.  The provisions of Minnesota 
  1.14  Statutes, sections 94.09 to 94.16 and 103F.535, do not apply to 
  1.15  real estate transactions authorized by this section. 
  1.16     Subd. 2.  [ST. CLOUD.] The board of trustees may purchase 
  1.17  fee title from the Central Minnesota Council of Boy Scouts, 
  1.18  Inc., of approximately 1.4 acres of land that includes an office 
  1.19  building and that is contiguous to St. Cloud Technical College 
  1.20  for college operations. 
  1.21     Subd. 3.  [INVER HILLS, NORMANDALE LAND TRANSFERS.] (a) The 
  1.22  board of trustees may transfer fee title to approximately eight 
  1.23  acres of state-owned real estate operated by Inver Hills 
  1.24  Community College to the city of Inver Grove Heights.  The 
  1.25  purpose of the transfer is to provide land for the construction 
  2.1   of a community library at no cost to the state, the board, or 
  2.2   Inver Hills Community College.  The transfer is contingent on 
  2.3   the board of trustees acquiring fee title to approximately eight 
  2.4   acres of real estate owned by the city of Inver Grove Heights, 
  2.5   adjacent to Inver Hills Community College, for college 
  2.6   operations. 
  2.7      (b) The board of trustees may transfer fee title to 
  2.8   approximately 12 acres of state-owned real estate that comprises 
  2.9   Normandale Community College's athletic fields to the city of 
  2.10  Bloomington.  The transfer is contingent on the board acquiring 
  2.11  fee title to approximately 12 acres of real estate owned by the 
  2.12  city of Bloomington, which is in the vicinity of Normandale 
  2.13  Community College, for college operations.  The transfer must 
  2.14  include provisions to allow the college continued use of the 
  2.15  fields. 
  2.16     Subd. 4.  [WINONA, JACKSON PROPERTY SALE.] (a) The board of 
  2.17  trustees may sell the state's interest in an aviation hanger and 
  2.18  related land operated by the Winona campus of Winona-Red Wing 
  2.19  Technical College for no less than the assessed value of the 
  2.20  property.  The sale may be by public auction, sealed bid, 
  2.21  listing with a real estate broker licensed under Minnesota 
  2.22  Statutes, chapter 82, or other means selected by the board of 
  2.23  trustees. 
  2.24     (b) The board of trustees may sell a former armory building 
  2.25  operated by the Jackson campus of Minnesota West Community and 
  2.26  Technical College for no less than the assessed value of the 
  2.27  property.  The sale may be by public auction, sealed bid, 
  2.28  listing with a real estate broker licensed under Minnesota 
  2.29  Statutes, chapter 82, or other means selected by the board of 
  2.30  trustees. 
  2.31     Subd. 5.  [CENTURY COLLEGE PROPERTY LEASING.] The board of 
  2.32  trustees may grant a leasehold interest in approximately four 
  2.33  acres of state-owned real estate operated by Century Community 
  2.34  and Technical College to the city of Mahtomedi for construction 
  2.35  of an ice arena.  The term of the leasehold interest must not 
  2.36  exceed 99 years.  The lease may contain those covenants as may 
  3.1   be required by the board of trustees and shall be subject to the 
  3.2   provisions of Minnesota Statutes, section 16A.695, to the extent 
  3.3   applicable.  The lease shall be in a form approved by the 
  3.4   attorney general. 
  3.5      Subd. 6.  [MINNEAPOLIS TRANSFER.] Notwithstanding the 
  3.6   provisions of Minnesota Statutes, chapter 94, or any other state 
  3.7   law, if the board of trustees of the Minnesota state college and 
  3.8   universities system or the school board of special school 
  3.9   district No. 1, Minneapolis, ceases to use its portion of the 
  3.10  real property along second avenue north adjacent to Bassett's 
  3.11  creek in Minneapolis known as the transportation center for a 
  3.12  purpose related to normal, authorized board functions or 
  3.13  activities, or if the board of trustees or the school board 
  3.14  wishes to permanently abandon, sell, or lease or otherwise 
  3.15  transfer the control of a material part of, its portion of the 
  3.16  real property, the board of trustees must offer to convey its 
  3.17  portion of the property to the school board for $1 or the school 
  3.18  board must offer to convey its portion of the property to the 
  3.19  board of trustees for $1.  The board of trustees and the school 
  3.20  board are each authorized to convey their portion of the 
  3.21  property upon timely acceptance of such offer.  An offer 
  3.22  extended shall become void if not accepted in writing within 60 
  3.23  days of issuance.
