1.1 A bill for an act 1.2 relating to commerce; authorizing an appeal to the 1.3 United States Environmental Protection Agency to allow 1.4 consumers increased access to nonoxygenated gasoline; 1.5 amending Minnesota Statutes 1996, section 239.791, 1.6 subdivision 1. 1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. Minnesota Statutes 1996, section 239.791, 1.9 subdivision 1, is amended to read: 1.10 Subdivision 1. [MINIMUM OXYGEN CONTENT REQUIRED.] Except 1.11 as provided in subdivisions 10 to 12 and any waiver from 1.12 regulations under the federal Clean Air Act granted by the 1.13 United States Environmental Protection Agency, a person 1.14 responsible for the product shall comply with the following 1.15 requirements: 1.16 (a) After October 1, 1995, gasoline sold or offered for 1.17 sale at any time in a carbon monoxide control area must contain 1.18 at least 2.7 percent oxygen by weight. 1.19 (b) After October 1, 1997, all gasoline sold or offered for 1.20 sale in Minnesota must contain at least 2.7 percent oxygen by 1.21 weight. 1.22 Sec. 2. [OXYGENATED GASOLINE MANDATE; PETITION FOR PARTIAL 1.23 WAIVER FROM EPA REGULATIONS.] 1.24 By October 1, 1997, the commissioner of the pollution 1.25 control agency shall submit to the United States Environmental 1.26 Protection Agency a petition requesting a permanent, limited 2.1 waiver from certain regulations under the federal Clean Air Act, 2.2 as amended. The petition for waiver must request authority for 2.3 the sale of nonoxygenated gasoline within a carbon monoxide 2.4 control area during a carbon monoxide control period to the same 2.5 extent currently provided outside a carbon monoxide control area 2.6 under Minnesota Statutes, section 239.791, subdivisions 10 to 2.7 12, except that during a carbon monoxide control period the 2.8 waiver shall not apply within Hennepin and Ramsey counties. 2.9 Sec. 3. [EFFECTIVE DATE.] 2.10 Section 1 is effective on the effective date of a waiver 2.11 granted under section 2. Section 2 is effective the day 2.12 following final enactment.
