A bill for an act
relating to human services; modifying age distribution restrictions for certain
group family day care settings; amending Minnesota Statutes 2014, section
245A.14, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 245A.14, is amended by adding a
subdivision to read:

new text begin Group family day care age distribution restrictions. new text end

new text begin (a) A group family
day care that has a licensed capacity of 14 children with two adult caregivers present and
that meets the requirements in paragraph (b) may serve up to 12 children under school
age. Of the 12 children under school age, a combined total of no more than five children
shall be infants and toddlers and no more than three children shall be infants.

new text begin (b) To meet the age distribution restrictions in paragraph (a), a group family day care
must hold a three-star or four-star rating in the quality rating and improvement system
under section 124D.142, and the two adult caregivers present at the group family day care
must meet the minimum staff licensure or certification requirements for the setting.
