  1.1                          A bill for an act 
  1.2             relating to insurance; requiring coverage for 
  1.3             monitoring for ovarian cancer for high-risk patients; 
  1.4             amending Minnesota Statutes 2002, section 62A.30, 
  1.5             subdivision 2; by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 62A.30, 
  1.8   subdivision 2, is amended to read: 
  1.9      Subd. 2.  [REQUIRED COVERAGE.] Every policy, plan, 
  1.10  certificate, or contract referred to in subdivision 1 issued or 
  1.11  renewed after August 1, 1988, that provides coverage to a 
  1.12  Minnesota resident must provide coverage for routine screening 
  1.13  procedures for cancer, including mammograms, monitoring for 
  1.14  ovarian cancer for women who are at special risk for ovarian 
  1.15  cancer as defined in subdivision 3, and pap smears, when ordered 
  1.16  or provided by a physician in accordance with the standard 
  1.17  practice of medicine.  Coverage required under this section is 
  1.18  subject to the enrollee cost-sharing provisions otherwise 
  1.19  required under the policy, plan, certificate, or contract for 
  1.20  similar services.  
  1.21     Sec. 2.  Minnesota Statutes 2002, section 62A.30, is 
  1.22  amended by adding a subdivision to read: 
  1.23     Subd. 3.  [OVARIAN CANCER MONITORING; DEFINITIONS.] For 
  1.24  purposes of subdivision 2: 
  1.25     (a) "Monitoring for ovarian cancer" means annual screening 
  2.1   using: 
  2.2      (1) CA-125 serum tumor marker testing; 
  2.3      (2) transvaginal ultrasound; and 
  2.4      (3) pelvic examination.  
  2.5      (b) "At special risk for ovarian cancer" means: 
  2.6      (1) having a family history: 
  2.7      (i) with one or more first or second-degree relatives with 
  2.8   ovarian cancer; 
  2.9      (ii) of clusters of women relatives with breast cancer; or 
  2.10     (iii) of nonpolyposis colorectal cancer; or 
  2.11     (2) having tested positive for BRCA1 or BRCA2 mutations. 
  2.12     Sec. 3.  [EFFECTIVE DATE.] 
  2.13     Sections 1 and 2 are effective August 1, 2004, and apply to 
  2.14  coverage issued or renewed on or after that date.
