  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  Minnesota Statutes 2000, section 15.059, 
  1.12  subdivision 5, is amended to read: 
  1.13     Subd. 5.  [EXPIRATION DATE.] (a) Unless a different date is 
  1.14  specified by law, the existence of each advisory council and 
  1.15  committee established before January 1, 1997, terminates June 
  1.16  30, 1997.  An advisory council or committee established by law 
  1.17  and in existence after June 30, 1997, expires on the date 
  1.18  specified in the law establishing the group or on June 30, 2001 
  1.19  2005, whichever is sooner.  This subdivision applies whether or 
  1.20  not the law establishing the group provides that the group is 
  1.21  governed by this section. 
  1.22     (b) An advisory council or committee does not expire in 
  1.23  accordance with paragraph (a) if it: 
  1.24     (1) is an occupational licensure advisory group to a 
  1.25  licensing board or agency; 
  1.26     (2) administers and awards grants; or 
  1.27     (3) is required by federal law or regulation. 
  2.1   A council or committee covered by this paragraph expires June 
  2.2   30, 2001 2005. 
  2.3      Sec. 2.  Minnesota Statutes 2000, section 15.059, 
  2.4   subdivision 5a, is amended to read: 
  2.5      Subd. 5a.  [LATER EXPIRATION.] Notwithstanding subdivision 
  2.6   5, the advisory councils and committees listed in this 
  2.7   subdivision do not expire June 30, 1997.  These groups expire 
  2.8   June 30, 2001 2005, unless the law creating the group or this 
  2.9   subdivision specifies an earlier expiration date.

  5.16     Sec. 3.  Minnesota Statutes 2000, section 62J.692, 
  5.17  subdivision 2, is amended to read: 
  5.18     Subd. 2.  [MEDICAL EDUCATION AND RESEARCH ADVISORY 
  5.19  COMMITTEE.] The commissioner shall appoint an advisory committee 
  5.20  to provide advice and oversight on the distribution of funds 
  5.21  appropriated for distribution under this section.  In appointing 
  5.22  the members, the commissioner shall:  
  5.23     (1) consider the interest of all stakeholders; 
  5.24     (2) appoint members that represent both urban and rural 
  5.25  interests; and 
  5.26     (3) appoint members that represent ambulatory care as well 
  5.27  as inpatient perspectives.  
  5.28  The commissioner shall appoint to the advisory committee 
  5.29  representatives of the following groups to ensure appropriate 
  5.30  representation of all eligible provider groups and other 
  5.31  stakeholders:  public and private medical researchers; public 
  5.32  and private academic medical centers, including representatives 
  5.33  from academic centers offering accredited training programs for 
  5.34  physicians, pharmacists, chiropractors, dentists, nurses, and 
  5.35  physician assistants; managed care organizations; employers; 
  5.36  consumers and other relevant stakeholders.  The advisory 
  6.1   committee is governed by section 15.059 for membership terms and 
  6.2   removal of members and expires on June 30, 2001. 
  6.3      Sec. 4.  Minnesota Statutes 2000, section 144.1481, 
  6.4   subdivision 1, is amended to read: 
  6.5      Subdivision 1.  [ESTABLISHMENT; MEMBERSHIP.] The 
  6.6   commissioner of health shall establish a 15-member rural health 
  6.7   advisory committee.  The committee shall consist of the 
  6.8   following members, all of whom must reside outside the 
  6.9   seven-county metropolitan area, as defined in section 473.121, 
  6.10  subdivision 2: 
  6.11     (1) two members from the house of representatives of the 
  6.12  state of Minnesota, one from the majority party and one from the 
  6.13  minority party; 
  6.14     (2) two members from the senate of the state of Minnesota, 
  6.15  one from the majority party and one from the minority party; 
  6.16     (3) a volunteer member of an ambulance service based 
  6.17  outside the seven-county metropolitan area; 
  6.18     (4) a representative of a hospital located outside the 
  6.19  seven-county metropolitan area; 
  6.20     (5) a representative of a nursing home located outside the 
  6.21  seven-county metropolitan area; 
  6.22     (6) a medical doctor or doctor of osteopathy licensed under 
  6.23  chapter 147; 
  6.24     (7) a midlevel practitioner; 
  6.25     (8) a registered nurse or licensed practical nurse; 
  6.26     (9) a licensed health care professional from an occupation 
  6.27  not otherwise represented on the committee; 
  6.28     (10) a representative of an institution of higher education 
  6.29  located outside the seven-county metropolitan area that provides 
  6.30  training for rural health care providers; and 
  6.31     (11) three consumers, at least one of whom must be an 
  6.32  advocate for persons who are mentally ill or developmentally 
  6.33  disabled. 
  6.34     The commissioner will make recommendations for committee 
  6.35  membership.  Committee members will be appointed by the 
  6.36  governor.  In making appointments, the governor shall ensure 
  7.1   that appointments provide geographic balance among those areas 
  7.2   of the state outside the seven-county metropolitan area.  The 
  7.3   chair of the committee shall be elected by the members.  The 
  7.4   terms, compensation, and removal of members are advisory 
  7.5   committee is governed by section 15.059, except that 
  7.6   the existence of the committee does not terminate and members do 
  7.7   not receive per diem compensation. 
  7.8      Sec. 5.  Minnesota Statutes 2000, section 145A.10, 
  7.9   subdivision 10, is amended to read: 
  7.10     Subd. 10.  [STATE AND LOCAL ADVISORY COMMITTEES.] (a) A 
  7.11  state community health advisory committee is established to 
  7.12  advise, consult with, and make recommendations to the 
  7.13  commissioner on the development, maintenance, funding, and 
  7.14  evaluation of community health services.  Section 15.059, 
  7.15  subdivision 5, applies to this committee.  Each community health 
  7.16  board may appoint a member to serve on the committee.  The 
  7.17  committee must meet at least quarterly, and special meetings may 
  7.18  be called by the committee chair or a majority of the members.  
  7.19  Members or their alternates may receive a per diem and must be 
  7.20  reimbursed for travel and other necessary expenses while engaged 
  7.21  in their official duties.  Notwithstanding section 15.059, 
  7.22  subdivision 5, or other law to the contrary, the advisory 
  7.23  committee does not expire. 
  7.24     (b) The city councils or county boards that have 
  7.25  established or are members of a community health board must 
  7.26  appoint a community health advisory committee to advise, consult 
  7.27  with, and make recommendations to the community health board on 
  7.28  matters relating to the development, maintenance, funding, and 
  7.29  evaluation of community health services.  The committee must 
  7.30  consist of at least five members and must be generally 
  7.31  representative of the population and health care providers of 
  7.32  the community health service area.  The committee must meet at 
  7.33  least three times a year and at the call of the chair or a 
  7.34  majority of the members.  Members may receive a per diem and 
  7.35  reimbursement for travel and other necessary expenses while 
  7.36  engaged in their official duties. 
  8.1      (c) State and local advisory committees must adopt bylaws 
  8.2   or operating procedures that specify the length of terms of 
  8.3   membership, procedures for assuring that no more than half of 
  8.4   these terms expire during the same year, and other matters 
  8.5   relating to the conduct of committee business.  Bylaws or 
  8.6   operating procedures may allow one alternate to be appointed for 
  8.7   each member of a state or local advisory committee.  Alternates 
  8.8   may be given full or partial powers and duties of members.  
  8.9      Sec. 6.  [REPEALER.] 
  8.10     Minnesota Statutes 2000, sections 256B.071, subdivision 5; 
  8.11  and 256B.0911, subdivision 8, are repealed. 
  8.12     Sec. 7.  [EFFECTIVE DATE.] 
  8.13     Sections 1 to 6 are effective the day following final 
  8.14  enactment.
