  1.1                          A bill for an act 
  1.2             relating to state government; modifying the expiration 
  1.3             date for certain advisory councils and committees; 
  1.4             eliminating certain advisory committees; amending 
  1.5             Minnesota Statutes 2000, sections 15.059, subdivision 
  1.6             5; 62J.692, subdivision 2; 144.1481, subdivision 1; 
  1.7             214.32, subdivision 1; repealing Minnesota Statutes 
  1.8             2000, sections 15.059, subdivision 5a, as amended; 
  1.9             256B.071, subdivision 5; 256B.0911, subdivision 8. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  Minnesota Statutes 2000, section 15.059, 
  1.12  subdivision 5, is amended to read: 
  1.13     Subd. 5.  [EXPIRATION DATE.] (a) Unless a different date is 
  1.14  specified by law, the existence of each advisory council and 
  1.15  committee established before January 1, 1997, terminates June 
  1.16  30, 1997.  An advisory council or committee established by law 
  1.17  and in existence after June 30, 1997, expires on the date 
  1.18  specified in the law establishing the group or on June 30, 2001 
  1.19  2003, whichever is sooner.  This subdivision applies whether or 
  1.20  not the law establishing the group provides that the group is 
  1.21  governed by this section. 
  1.22     (b) An advisory council or committee does not expire in 
  1.23  accordance with paragraph (a) if it: 
  1.24     (1) is an occupational licensure advisory group to a 
  1.25  licensing board or agency; 
  1.26     (2) administers and awards grants; or 
  1.27     (3) is required by federal law or regulation. 
  2.1   A council or committee covered by this paragraph expires June 
  2.2   30, 2001. 
  2.3      Sec. 2.  Minnesota Statutes 2000, section 62J.692, 
  2.4   subdivision 2, is amended to read: 
  2.5      Subd. 2.  [MEDICAL EDUCATION AND RESEARCH ADVISORY 
  2.6   COMMITTEE.] The commissioner shall appoint an advisory committee 
  2.7   to provide advice and oversight on the distribution of funds 
  2.8   appropriated for distribution under this section.  In appointing 
  2.9   the members, the commissioner shall:  
  2.10     (1) consider the interest of all stakeholders; 
  2.11     (2) appoint members that represent both urban and rural 
  2.12  interests; and 
  2.13     (3) appoint members that represent ambulatory care as well 
  2.14  as inpatient perspectives.  
  2.15  The commissioner shall appoint to the advisory committee 
  2.16  representatives of the following groups to ensure appropriate 
  2.17  representation of all eligible provider groups and other 
  2.18  stakeholders:  public and private medical researchers; public 
  2.19  and private academic medical centers, including representatives 
  2.20  from academic centers offering accredited training programs for 
  2.21  physicians, pharmacists, chiropractors, dentists, nurses, and 
  2.22  physician assistants; managed care organizations; employers; 
  2.23  consumers and other relevant stakeholders.  The advisory 
  2.24  committee is governed by section 15.059 for membership terms and 
  2.25  removal of members and expires on June 30, 2001. 
  2.26     Sec. 3.  Minnesota Statutes 2000, section 144.1481, 
  2.27  subdivision 1, is amended to read: 
  2.28     Subdivision 1.  [ESTABLISHMENT; MEMBERSHIP.] The 
  2.29  commissioner of health shall establish a 15-member rural health 
  2.30  advisory committee.  The committee shall consist of the 
  2.31  following members, all of whom must reside outside the 
  2.32  seven-county metropolitan area, as defined in section 473.121, 
  2.33  subdivision 2: 
  2.34     (1) two members from the house of representatives of the 
  2.35  state of Minnesota, one from the majority party and one from the 
  2.36  minority party; 
  3.1      (2) two members from the senate of the state of Minnesota, 
  3.2   one from the majority party and one from the minority party; 
  3.3      (3) a volunteer member of an ambulance service based 
  3.4   outside the seven-county metropolitan area; 
  3.5      (4) a representative of a hospital located outside the 
  3.6   seven-county metropolitan area; 
  3.7      (5) a representative of a nursing home located outside the 
  3.8   seven-county metropolitan area; 
  3.9      (6) a medical doctor or doctor of osteopathy licensed under 
  3.10  chapter 147; 
  3.11     (7) a midlevel practitioner; 
  3.12     (8) a registered nurse or licensed practical nurse; 
  3.13     (9) a licensed health care professional from an occupation 
  3.14  not otherwise represented on the committee; 
  3.15     (10) a representative of an institution of higher education 
  3.16  located outside the seven-county metropolitan area that provides 
  3.17  training for rural health care providers; and 
  3.18     (11) three consumers, at least one of whom must be an 
  3.19  advocate for persons who are mentally ill or developmentally 
  3.20  disabled. 
  3.21     The commissioner will make recommendations for committee 
  3.22  membership.  Committee members will be appointed by the 
  3.23  governor.  In making appointments, the governor shall ensure 
  3.24  that appointments provide geographic balance among those areas 
  3.25  of the state outside the seven-county metropolitan area.  The 
  3.26  chair of the committee shall be elected by the members.  The 
  3.27  terms, compensation, and removal of members are advisory 
  3.28  committee is governed by section 15.059, except that 
  3.29  the existence of the committee does not terminate and members do 
  3.30  not receive per diem compensation. 
  3.31     Sec. 4.  Minnesota Statutes 2000, section 214.32, 
  3.32  subdivision 1, is amended to read: 
  3.33     Subdivision 1.  [MANAGEMENT.] (a) A health professionals 
  3.34  services program committee is established, consisting of one 
  3.35  person appointed by each participating board, with each 
  3.36  participating board having one vote.  The committee shall 
  4.1   designate one board to provide administrative management of the 
  4.2   program, set the program budget and the pro rata share of 
  4.3   program expenses to be borne by each participating board, 
  4.4   provide guidance on the general operation of the program, 
  4.5   including hiring of program personnel, and ensure that the 
  4.6   program's direction is in accord with its authority.  If the 
  4.7   participating boards change which board is designated to provide 
  4.8   administrative management of the program, any appropriation 
  4.9   remaining for the program shall transfer to the newly designated 
  4.10  board on the effective date of the change.  The participating 
  4.11  boards must inform the appropriate legislative committees and 
  4.12  the commissioner of finance of any change in the administrative 
  4.13  management of the program, and the amount of any appropriation 
  4.14  transferred under this provision. 
  4.15     (b) The designated board, upon recommendation of the health 
  4.16  professional services program committee, shall hire the program 
  4.17  manager and employees and pay expenses of the program from funds 
  4.18  appropriated for that purpose.  The designated board may apply 
  4.19  for grants to pay program expenses and may enter into contracts 
  4.20  on behalf of the program to carry out the purposes of the 
  4.21  program.  The participating boards shall enter into written 
  4.22  agreements with the designated board. 
  4.23     (c) An advisory committee is established to advise the 
  4.24  program committee consisting of: 
  4.25     (1) one member appointed by each of the following:  the 
  4.26  Minnesota Academy of Physician Assistants, the Minnesota Dental 
  4.27  Association, the Minnesota Chiropractic Association, the 
  4.28  Minnesota Licensed Practical Nurse Association, the Minnesota 
  4.29  Medical Association, the Minnesota Nurses Association, and the 
  4.30  Minnesota Podiatric Medicine Association; 
  4.31     (2) one member appointed by each of the professional 
  4.32  associations of the other professions regulated by a 
  4.33  participating board not specified in clause (1); and 
  4.34     (3) two public members, as defined by section 214.02.  
  4.35  Members of the advisory committee shall be appointed for two 
  4.36  years and members may be reappointed.  
  5.1      The advisory committee expires June 30, 2001 2003. 
  5.2      Sec. 5.  [REPEALER.] 
  5.3      Minnesota Statutes 2000, sections 15.059, subdivision 5a, 
  5.4   as amended by Laws 2001, chapter 7, section 7; 256B.071, 
  5.5   subdivision 5; and 256B.0911, subdivision 8, are repealed. 
  5.6      Sec. 6.  [EFFECTIVE DATE.] 
  5.7      Sections 1 to 5 are effective the day following final 
  5.8   enactment.
