  1.1                          A bill for an act 
  1.2             relating to human services; allowing residents of 
  1.3             adult foster care facilities to execute health care 
  1.4             directives; amending Minnesota Statutes 2002, section 
  1.5             145C.01, subdivision 7. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 145C.01, 
  1.8   subdivision 7, is amended to read: 
  1.9      Subd. 7.  [HEALTH CARE FACILITY.] "Health care facility" 
  1.10  means a hospital or other entity licensed under sections 144.50 
  1.11  to 144.58, a nursing home licensed to serve adults under section 
  1.12  144A.02, a home care provider licensed under sections 144A.43 to 
  1.13  144A.47, an adult foster care provider licensed under chapter 
  1.14  245A and Minnesota Rules, parts 9555.5105 to 9555.6265, or a 
  1.15  hospice provider licensed under sections 144A.75 to 144A.755. 
  1.16     Sec. 2.  [RULE AMENDMENT.] 
  1.17     The commissioner of human services shall amend Minnesota 
  1.18  Rules, part 9555.5105, subpart 20, to expand the definition of 
  1.19  "legal representative" to include a health care agent appointed 
  1.20  by a principal in a health care power of attorney to make health 
  1.21  care decisions as provided in Minnesota Statutes, chapter 145C.  
  1.22  The commissioner shall adopt rule amendments required by this 
  1.23  section using the authority of Minnesota Statutes, section 
  1.24  14.388, subdivision 1, clause (3).
