  1.1                          A bill for an act 
  1.2             relating to education; appropriating money to fund the 
  1.3             advanced placement and international baccalaureate 
  1.4             programs. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [APPROPRIATION.] 
  1.7      Subdivision 1.  [DEPARTMENT OF CHILDREN, FAMILIES, AND 
  1.8   LEARNING.] The sums indicated in this section are appropriated 
  1.9   from the general fund to the department of children, families, 
  1.10  and learning for the fiscal years designated. 
  1.11     Subd. 2.  [ADVANCED PLACEMENT AND INTERNATIONAL 
  1.12  BACCALAUREATE PROGRAMS.] For the state advanced placement and 
  1.13  international baccalaureate programs, including public school 
  1.14  teacher summer training programs, follow-up teacher support 
  1.15  workshops, examination fee subsidies, and student scholarships: 
  1.16       $2,375,000     .....     1998 
  1.17       $2,375,000     .....     1999 
  1.18     $250,000 each year is for teachers to attend subject matter 
  1.19  summer training programs and follow-up support workshops 
  1.20  approved by the advanced placement or international 
  1.21  baccalaureate programs.  The amount of the subsidy for each 
  1.22  advanced placement and international baccalaureate teacher shall 
  1.23  be the same.  The commissioner shall determine the payment 
  1.24  process and the amount of the subsidy. 
  1.25     Notwithstanding Minnesota Statutes, section 126.239, 
  2.1   subdivision 3, $1,250,000 each year is for the commissioner to 
  2.2   pay all examination fees for all students sitting for an 
  2.3   advanced placement examination, international baccalaureate 
  2.4   examination, or both.  If this amount is not adequate, the 
  2.5   commissioner may pay less than the full examination fee. 
  2.6      $500,000 each year is for student scholarships.  A student 
  2.7   scholarship shall be awarded to a student scoring 3, 4, or 5 on 
  2.8   one or more advanced placement examinations or 4, 5, 6, or 7 on 
  2.9   one or more international baccalaureate examinations.  A student 
  2.10  receiving a score of 5 on an advanced placement examination or 7 
  2.11  on an international baccalaureate examination shall receive a 
  2.12  scholarship of $500.  A student receiving a score of 4 on an 
  2.13  advanced placement examination or a score of 5 or 6 on an 
  2.14  international baccalaureate examination shall receive a 
  2.15  scholarship of $300.  A student receiving a score of 3 on an 
  2.16  advanced placement examination or 4 on an international 
  2.17  baccalaureate examination shall receive a scholarship of $150.  
  2.18  The scholarships shall be awarded only to students who are 
  2.19  enrolled in a Minnesota public or private college or 
  2.20  university.  The total amount of each scholarship shall be paid 
  2.21  directly to the student's designated college or university and 
  2.22  must be used by the student only for tuition, required fees, and 
  2.23  books in nonsectarian courses or programs.  The higher education 
  2.24  services office in consultation with the commissioner shall 
  2.25  determine the payment process, the amount of the scholarships, 
  2.26  and provisions for unused scholarships.  
  2.27     In order to be eligible to receive advanced placement or 
  2.28  international baccalaureate scholarships on behalf of the 
  2.29  qualifying students, the college or university must have an 
  2.30  advanced placement, international baccalaureate, or both, credit 
  2.31  and placement policy for the scholarship recipients.  In 
  2.32  addition, each college or university must certify these policies 
  2.33  to the department each year.  The department must provide each 
  2.34  secondary school in the state with a copy of the post-secondary 
  2.35  advanced placement and international baccalaureate policies each 
  2.36  year. 
  3.1      $375,000 each year is for teacher stipends.  A teacher who 
  3.2   teaches an advanced placement or international baccalaureate 
  3.3   course shall receive a stipend for each student in that 
  3.4   teacher's course who receives a qualifying score on the advanced 
  3.5   placement or international baccalaureate examination that covers 
  3.6   the subject matter of the course.  In this section, "qualifying 
  3.7   score" means 3 or better on an advanced placement examination 
  3.8   and 4 or better on an international baccalaureate examination.  
  3.9   Teacher stipend amounts shall be $50 for each student who scores 
  3.10  a 5 on an advanced placement examination or 7 on an 
  3.11  international baccalaureate examination, $40 for each student 
  3.12  who scores a 4 on an advanced placement examination or a 5 or 6 
  3.13  on an international baccalaureate examination, and $25 for each 
  3.14  student who scores a 3 on an advanced placement examination or a 
  3.15  4 on an international baccalaureate examination.  The 
  3.16  commissioner shall determine the payment process and the amount 
  3.17  of the teacher stipend. 
  3.18     A stipend awarded to a teacher under this subdivision shall 
  3.19  not be a mandatory subject of bargaining under Minnesota 
  3.20  Statutes, chapter 179A, or any other law and shall not be a term 
  3.21  or condition of employment.  The amount of any award shall be 
  3.22  final and shall not be subject to review by an arbitrator 
  3.23  through any grievance or other process or by a court through any 
  3.24  appeal process.  
  3.25     Any balance in the first year does not cancel but is 
  3.26  available in the second year.
