1.1A bill for an act
1.2relating to occupations and professions; regulating the practice of plumbing;
1.3regulating work on medical gas systems;proposing coding for new law in
1.4Minnesota Statutes, chapter 326B.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [326B.438] MEDICAL GAS SYSTEMS.
1.7    Subdivision 1. Definitions. (a) For the purposes of this section, the terms defined in
1.8this subdivision have the meanings given them.
1.9(b) "Level 1 medical piped gas and vacuum system" means a system serving
1.10occupancies where interruption of the medical piped gas and vacuum system would place
1.11patients in imminent danger of morbidity or mortality.
1.12(c) "Level 2 medical piped gas and vacuum system" means a system serving
1.13occupancies where interruption of the medical piped gas and vacuum system would place
1.14patients at manageable risk of morbidity or mortality.
1.15(d) "Level 3 medical piped gas and vacuum system" means a system serving
1.16occupancies where interruption of the medical piped gas and vacuum system would
1.17terminate procedures and may place the patient's health at risk, but would not place
1.18patients at risk of morbidity or mortality.
1.19(e) "Medical gas system" means a level 1, 2, or 3 piped medical gas and vacuum
1.20system.
1.21    Subd. 2. License required. No person shall engage in the installation, maintenance,
1.22or repair of a medical gas system unless the person possesses a current Minnesota
1.23journeyman plumber's license and is certified by rules adopted by the Minnesota Plumbing
1.24Board.
2.1    Subd. 3. Exceptions. An employee of the employer with a medical gas system
2.2may maintain the employer's medical gas system without complying with subdivision 2
2.3if the employer employs a person holding current certification from the National Fire
2.4Protection Association as of August 1, 2009, in medical gas system installation. A person
2.5so certified by the National Fire Protection Association may maintain and repair an
2.6employer's medical gas system.
2.7EFFECTIVE DATE.This section is effective August 1, 2009, except that the
2.8requirement that a journeyman plumber must be certified by the Minnesota Plumbing
2.9Board is not effective until 180 days after the board adopts rules.
