  1.1                          A bill for an act 
  1.2             relating to the environment; changing an appropriation 
  1.3             for landfill cleanup costs from the proceeds of bonds 
  1.4             from the solid waste fund to an appropriation for the 
  1.5             same purpose from the general fund; amending Laws 
  1.6             1996, chapter 470, section 24. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Laws 1996, chapter 470, section 24, is amended 
  1.9   to read: 
  1.10     Sec. 24.  [LANDFILL CLEANUP COSTS.] 
  1.11     (a) Notwithstanding Minnesota Statutes, sections 115B.42 
  1.12  and 115B.43, $737,500 is appropriated from the solid waste 
  1.13  general fund to the commissioner of the pollution control agency 
  1.14  for distribution to a county or its political subdivisions to 
  1.15  assist those public entities by funding a portion of the 
  1.16  $1,475,000 amount paid by December 31, 1994, as part of a final 
  1.17  order or settlement of a lawsuit for environmental response 
  1.18  costs at a mixed municipal solid waste facility if: 
  1.19     (1) the county or its political subdivisions stopped 
  1.20  sending waste to the facility prior to 1988; 
  1.21     (2) the mixed municipal solid waste facility is owned and 
  1.22  operated by another county; 
  1.23     (3) the county that owns the facility decided to reopen the 
  1.24  facility after a closure order was issued by the pollution 
  1.25  control agency in 1988, and then decided not to enter the 
  1.26  landfill cleanup program in 1994; and 
  2.1      (4) the county or its political subdivision incurring the 
  2.2   $1,475,000 liability had no role in the other county's decision 
  2.3   to keep the facility open. 
  2.4      (b) Reimbursements under this section must be used to 
  2.5   directly reduce or eliminate the burden on citizens of the 
  2.6   county caused by this liability, and may not be used for general 
  2.7   purposes. 
  2.8      Only proceeds from the sale of bonds credited to the solid 
  2.9   waste fund should be used to fund reimbursements under this 
  2.10  section.
