A bill for an act
relating to traffic safety; expanding and protecting certain data items on death
certificates of decedents; providing surviving family members greater access to
crashed vehicles; amending Minnesota Statutes 2008, sections 13.10, by adding
a subdivision; 169.09, by adding a subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2008, section 13.10, is amended by adding a subdivision
to read:

Notwithstanding any other provision of this
chapter or chapter 144, the Social Security number of a decedent on the decedent's death
certificate is classified as private data on decedents, in accordance with subdivision 2.

This section is effective July 1, 2009, and applies to death
certificates filed with the state registrar on or after that date.

Minnesota Statutes 2008, section 169.09, is amended by adding a subdivision
to read:

Notwithstanding any other provision of
Minnesota Statutes, the immediate family members, and their designees, of any decedent
who has died within ten days and as the result of a motor vehicle accident shall have right
of access to any motor vehicle involved in that accident for a period of no less than 15
days following the funeral of the decedent.

This section is effective July 1, 2009, and applies to fatal
motor vehicle crashes occurring on or after that date.

(a) Notwithstanding Minnesota Statutes, section 144.213, or any other provision
of Minnesota Statutes, chapter 144, the state registrar shall, at the earliest practicable
date in the judgment of the state registrar, add to the information collected on the death
certificate the mother's married surname.

(b) Notwithstanding Minnesota Statutes, section 144.221, or any other provision
of Minnesota Statutes, chapter 144, the state registrar and local registrars shall cease
collecting the deceased person's Social Security number on the death certificate.
