  1.1                          A bill for an act 
  1.2             relating to railroads; requiring a minimum number of 
  1.3             persons on train crews; granting rulemaking authority; 
  1.4             providing a civil penalty; proposing coding for new 
  1.5             law in Minnesota Statutes, chapter 219. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [219.382] [RAILROAD TRAIN CREWS.] 
  1.8      Subdivision 1.  [MINIMUM NUMBER.] A person operating or 
  1.9   controlling any railroad, as defined in section 218.011, 
  1.10  subdivision 3, shall not allow the operation of any railroad 
  1.11  train or locomotive between terminals in this state unless the 
  1.12  railroad train or locomotive has a crew of at least two 
  1.13  individuals. 
  1.14     Subd. 2.  [EXEMPTIONS.] The commissioner may, by rule, 
  1.15  grant an exemption to subdivision 1 if the commissioner 
  1.16  determines that the exemption will not endanger the life or 
  1.17  property of any person.  
  1.18     Subd. 3.  [FINE.] A person who violates subdivision 1 is 
  1.19  subject to a fine of not less than $25 nor more than $100 for 
  1.20  the first offense, not less than $100 nor more than $500 for a 
  1.21  second offense committed within three years, and not less than 
  1.22  $500 nor more than $1,000 for a third offense or more committed 
  1.23  within three years.
