  1.1                          A bill for an act
  1.2             relating to human services; clarifying medical 
  1.3             assistance coverage of skilled nursing facility and 
  1.4             hospice services for dual eligibles; amending 
  1.5             Minnesota Statutes 2002, sections 256B.0625, by adding 
  1.6             a subdivision; 256B.071, by adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 256B.0625, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 2a.  [SKILLED NURSING FACILITY AND HOSPICE SERVICES 
  1.11  FOR DUAL ELIGIBLES.] (a) Medical assistance covers skilled 
  1.12  nursing facility services for individuals eligible for both 
  1.13  medical assistance and Medicare who have waived the Medicare 
  1.14  skilled nursing facility room and board benefit and have 
  1.15  enrolled in the Medicare hospice program.  Medical assistance 
  1.16  covers skilled nursing facility services regardless of whether 
  1.17  an individual enrolled in the Medicare hospice program prior to, 
  1.18  on, or after the date of the hospitalization that qualified the 
  1.19  individual for Medicare skilled nursing facility services.  
  1.20  Medical assistance coverage of skilled nursing facility services 
  1.21  takes effect on the day the individual enrolls in the Medicare 
  1.22  hospice program, and is secondary to coverage under the Medicare 
  1.23  hospice program. 
  1.24     (b) Medical assistance covers hospice services for 
  1.25  individuals eligible for both medical assistance and Medicare 
  1.26  who are qualified for and receiving services under the Medicare 
  2.1   skilled nursing facility room and board benefit.  Medical 
  2.2   assistance coverage of hospice services for these individuals 
  2.3   takes effect on the day the individual begins a nursing home 
  2.4   stay covered under Medicare, and is secondary to coverage under 
  2.5   the Medicare skilled nursing facility room and board benefit. 
  2.6      Sec. 2.  Minnesota Statutes 2002, section 256B.071, is 
  2.7   amended by adding a subdivision to read: 
  2.8      Subd. 6.  [APPLICATION.] This section does not prohibit 
  2.9   medical assistance coverage of hospice services for individuals 
  2.10  eligible for both medical assistance and Medicare who are 
  2.11  qualified for and receiving services under the Medicare skilled 
  2.12  nursing facility room and board benefit, as provided under 
  2.13  section 256B.0625, subdivision 2a.
