  1.1                          A bill for an act 
  1.2             relating to human services; requiring the Department 
  1.3             of Human Services to adjust nursing facility payment 
  1.4             rates under specified circumstances; amending 
  1.5             Minnesota Statutes 2002, section 256B.431, subdivision 
  1.6             10. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 256B.431, 
  1.9   subdivision 10, is amended to read: 
  1.10     Subd. 10.  [PROPERTY RATE ADJUSTMENTS AND CONSTRUCTION 
  1.11  PROJECTS.] A nursing facility's request for a property-related 
  1.12  payment rate adjustment and the related supporting documentation 
  1.13  of project construction cost information must be submitted to 
  1.14  the commissioner within 60 days after the construction project's 
  1.15  completion date to be considered eligible for a property-related 
  1.16  payment rate adjustment.  Provided that all other eligibility 
  1.17  conditions are satisfied, the commissioner shall provide a rate 
  1.18  adjustment notice reflecting the submitted cost information 
  1.19  within 30 days after receiving such information.  Construction 
  1.20  projects with completion dates within one year of the completion 
  1.21  date associated with the property rate adjustment request and 
  1.22  phased projects with project completion dates within three years 
  1.23  of the last phase of the phased project must be aggregated for 
  1.24  purposes of the minimum thresholds in subdivisions 16 and 17, 
  1.25  and the maximum threshold in section 144A.071, subdivision 2.  
  1.26  "Construction project" and "project construction costs" have the 
  2.1   meanings given them in Minnesota Statutes, section 144A.071, 
  2.2   subdivision 1a.
