  1.1                          A bill for an act 
  1.2             relating to child care assistance; providing for a 
  1.3             family's temporary ineligibility for child care 
  1.4             assistance; amending Minnesota Statutes 2002, section 
  1.5             119B.09, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 119B.09, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 11.  [TEMPORARY INELIGIBILITY.] Counties must reserve 
  1.10  a family's position under the child care assistance fund if a 
  1.11  family has been receiving child care assistance but is 
  1.12  temporarily ineligible for assistance.  Employed participants 
  1.13  may be temporarily ineligible for a maximum of one academic 
  1.14  quarter or semester, as determined by the education 
  1.15  institution.  Activated military personnel may be temporarily 
  1.16  ineligible until deactivation.  A county may reserve an employed 
  1.17  or student family's position, and must reserve a military 
  1.18  family's position, on the basic sliding fee waiting list under 
  1.19  the child care assistance fund if a family is approved to 
  1.20  receive child care assistance and reaches the top of the waiting 
  1.21  list but is temporarily ineligible for assistance. 
  1.22     [EFFECTIVE DATE.] This section is effective the day 
  1.23  following final enactment.
