  1.1                          A bill for an act 
  1.2             relating to traffic regulations; requiring driver to 
  1.3             control the vehicle when approaching authorized 
  1.4             emergency vehicles stopped on the right-of-way; 
  1.5             imposing surcharge for violation; amending Minnesota 
  1.6             Statutes 1996, section 169.14, subdivision 3. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1996, section 169.14, 
  1.9   subdivision 3, is amended to read: 
  1.10     Subd. 3.  [REDUCED SPEED REQUIRED.] (a) The driver of any 
  1.11  vehicle shall, consistent with the requirements, drive at an 
  1.12  appropriate reduced speed when: 
  1.13     (1) approaching and crossing an intersection or railway 
  1.14  grade crossing, when; 
  1.15     (2) approaching and going around a curve, when; 
  1.16     (3) approaching a hill crest, when; 
  1.17     (4) traveling upon any narrow or winding roadway, and when; 
  1.18  or 
  1.19     (5) special hazards exist with respect to pedestrians or 
  1.20  other traffic or by reason of weather or highway conditions.  
  1.21     (b) The driver of any vehicle shall ensure that the vehicle 
  1.22  is kept under control whenever approaching or passing an 
  1.23  authorized emergency vehicle stopped with emergency lights 
  1.24  flashing on the right-of-way of any street or highway.  The 
  1.25  exercise of control required for a driver to comply with this 
  1.26  paragraph is that control possible and necessary by the driver 
  2.1   to absolutely prevent injury to person or property and to 
  2.2   absolutely avoid interference with the performance of emergency 
  2.3   duties by emergency personnel.  
  2.4      (c) A person who violates paragraph (b) shall be assessed 
  2.5   an additional surcharge equal to two times the amount of the 
  2.6   fine imposed for the speed violation, but not less than $50.  
  2.7      Sec. 2.  [EFFECTIVE DATE.] 
  2.8      Section 1 is effective August 1, 1997, for violations 
  2.9   occurring on and after that date.
