  1.1                          A bill for an act 
  1.2             relating to state lands; authorizing the conveyance of 
  1.3             certain state land in Roseau county. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [CONVEYANCE OF STATE LAND; ROSEAU COUNTY.] 
  1.6      (a) Notwithstanding Minnesota Statutes, sections 94.09 to 
  1.7   94.16, the commissioner of natural resources shall convey the 
  1.8   land described in paragraph (c) to Mr. Arlan Dalager for no 
  1.9   consideration. 
  1.10     (b) The conveyance must be in a form approved by the 
  1.11  attorney general. 
  1.12     (c) The land to be conveyed is located in Roseau county and 
  1.13  is shown as encroachment area, consisting of approximately 2.8 
  1.14  acres, on an encroachment map prepared by the department of 
  1.15  natural resources and dated March 9, 1995, file number 
  1.16  SNA01065.00.00.01. 
  1.17     (d) The conveyance resolves an inadvertent encroachment by 
  1.18  Mr. Dalager on the Two Rivers Aspen Parkland Prairie scientific 
  1.19  and natural area.  The area of encroachment is of negligible 
  1.20  value to the state and is separated from the rest of the 
  1.21  scientific and natural area by a drainage ditch that runs 
  1.22  roughly parallel to the boundary of Mr. Dalager's land.  Since 
  1.23  Mr. Dalager purchased his land in 1974, he has presumed that a 
  1.24  fence running along the drainage ditch delineated his property 
  2.1   boundary.  The encroachment was not discovered until 1992, when 
  2.2   the state acquired the adjacent property. 
  2.3      Sec. 2.  [EFFECTIVE DATE.] 
  2.4      Section 1 is effective the day following final enactment.
